I think most contracts would have a death clause but thinking about this more... if the future groom and Miscer CEO signed the contract then the future bride was never a party to that agreement. Would she be affected, sure but if she did not physically sign then it would be an agreement between the two men.

All that being said it’s still stupid to not refund but as we can see this is not a legitimate operation anyways as he is likely just pocketing the cash.. and potentially frauding altogether

holy fuk this whole thread is just lol.. and fkn lol'd hard at him changing the business name.

I can understand both sides of the argument (being a business owner myself). This whole situation could have been easily resolved in many different ways: giving the client a credit of $1800 for lets say next 2-3 years.. or giving a partial refund.. or telling the client that his money will be refunded by the end of the year (once corona is over - as all businesses are struggling).. and finally if he didn't want to refund at all.. they could have organised a phone call / face to face meeting and tried to make the client understand nicely... the CEO is a dick for behaving the way he behaved.. and the client is a dick for doing what he did (despite his circumstances)... but i guess all this is invalid now that we know this guy is a con artist and has done this to many other people in the past lol

All I can say to wedding photographers / videographers is screen your clients and chose them carefully.. its not worth the money in the long run to shoot everyones wedding because of situations like these. I've had some sh!tty clients in the past which I regretted taking on and thank god i've learnt now and I can see a sh!ty client from a mile away.

There are two fights here;

1st - There is a legally binding contract with no-refund policy attached to it. The Business can, and if taken to court, not only keep the money but they will sue the was-to-be-a-husband for reputation damage.

2nd- Three months notice is far more than enough, but again if the husband signed the contract with no refund then it means no refund. So we have the moral fight. Doing whats right by the business.


If this goes to court, the husband is fuked beyond repair not only he wont take his money back but he will be charged for reputation damage and legal expenses unless he hires a good lawyer and manages to find a case that would force the company to refund and cover legal expenses.

If this was my business, I would have refunded the money even with the no-refund contract. It is just not worth all the hassle.

i would have to imagine he would lose in court. yea it says non-refundable but it seems like payment for a future service. and the future service now doesn't exist

so, the guy paid for a service he never received. i don't see why people would have to part money for things they never received

im pretty positive it would be easy to paint him as a scammer and a thief

edit: AND i would imagine any judge that were to take this on already doesn't like the dude. so you can prob throw in the "libel, slander, reputation damage, emotional damages, etc.," on here as well and get to some HEAVY $$

Contracts become invalid due to acts of God, death, circumstances not stated in the contract all the time. Contracts aren't above law so you can't say for certain he's "fukked."
