You guys didn't see A1's post? If you're a part of HOA you don't have a right to defend your gated neighborhood? I mean that's obvious, right?

I LOVE how some people will just accept a roshambo as "fair enough." Just add an extra legal step in there and they're fine with you taking away their rights.

There's a fair case to be made that they had a good faith belief they were defending their property, even if they technically were not. Wildly waving guns at people standing on the sidewalk, however, is a lot to ask people to accept when the facts tend toward them fabricating all their extraordinarily dramatic claims about what happened. Based on what's available now, it's closer to Texas Machetebrah sperging out and getting beaten down in a fight the police correctly determined he started.

If the sidewalk really is private HOA property, the protesters should definitely be charged, but lots of people live in HOAs with privately-held common spaces. It doesn't mean they have any authority to threaten non-residents with deadly weapons for being in them. Reading the statute, there'd be very little argument for a crime here if they'd just exercised potato-level muzzle discipline.

Both sides can be guilty of crimes at the same time, over the same incident.

It's obvious where this is going. They want 'peaceful protestors' to be able to kill you and burn your house down without reprise, and if you resist you'll be the ones who get arrested.

Good luck if Trump loses in November.

Uh-huh.

They claimed that a "horde" of people smashed the gate to pieces and poured through it, coming toward them.

They claimed that they were eating dinner and asked the protesters to leave before arming themselves. They've also claimed that they were threatened by armed people in body armor, threatening to kill them, their dog, burn their house, and burn their office.

Their attorney made a statement that they witnessed two individuals violently ripping the gate, who subsequently charged them and threatened them, and that this is the point at which they initially became frightened.

Unfortunately, most of the homeowners' story is a blatant lie. In fact, the gate was opened, undamaged, and he was seemingly already armed and training a rifle on them on people walking past their home as soon as they entered the neighborhood.

I am unaware of any state that defines opening a gate, even a locked one, as a forcible felony. The classics are rape, robbery, arson, and murder. Please elaborate.

EDIT: Missouri Laws 563.011.

"'Forcible felony', any felony involving the use or threat of physical force or violence against any individual, including but not limited to murder, robbery, burglary, arson, kidnapping, assault, and any forcible sexual offense;"

Who'd they rape to get in there?

It's very likely, based on the facts we have, and assuming that the sidewalk actually has some enforceable private status, that they committed misdemeanor first degree trespassing. Guess who may haveactuallycommitted a forcible felony on camera?

Your arguments in appeal to the letter of the law are in blatant disagreement with the spirit of the law. Regardless of the details you are nitpicking, no man should have to suffer a pack of violent people coming onto his property and threatening him. You claim they "dindu nuffin", but everybody knows that they had malicious intent, knows that they mean ill-will to those who have what they do not, knows that they are reckless lowlifes. Argue with specific definitions of things all you want, it doesn't change the fact that good, reasonable men see that what the man did is entirely justified. Your appeal to byzantine written laws in order to justify your argument, rather than an appeal to common sense and the natural laws that men live by and judge each other by unconsciously, shows how intellectually bankrupt you are, how disconnected from reality you've become. You no longer think in terms of what is right, or what makes sense, instead trying to justify harm to a man defending himself and his property from violent interlopers with any excuse you can pull out of your ass.

Has there been any recent history of "peaceful" groups of people protesting and endangering life or property? I am trying to think of any recent examples of people protesting that resulted in otherwise innocent people having their property stolen, destroyed, or burned. Please help me if you can think of an example.

Ah glad you could display your bias so willingly.

An incited, angry mobbreaking and entering is most definitely a force-able felonyas you'd assume their intent is to harm. That's not even debatable. The law you cited doesn't exclude it. You keep rehashing arguments as if they reinforce your position and it only waters it down.

I've no doubt that crowd caused the damage to the gate. Just to be clear, are you claiming it's staged?

They marched into a private property with no trespassing sign on it. I can't believe more people didn't do this. I'm sure they're paying pretty high HOA. Where were they at?

Defensive display is totally understandable here, but that wasn't what this was. Wife actually came down off the porch to get up close to them and aim a pistol at their heads for standing on the sidewalk. At no point did they seem to be making anyone "aware they plan to defend their property". They were repeatedly trying to verbally trespass them out of the entire neighborhood, which they do not own.

Missouri law does exclude it, because a B&E of a posted fence gate 1) is not violence nor a threat of violence against an individual, and 2) is simply not a felony in Missouri, nor in most states, despite Missouri having some very broad property defense laws.
I've no doubt that crowd caused the damage to the gate. Just to be clear, are you claiming it's staged?
I am claiming exactly what I already said: it is proven that the homeowners were lying about the gate. It was not relevant to their justification for aiming firearms at people on their sidewalk, because it didn't happen. Playing guessing games about what happened to it later is fun but doesn't matter. They're also now almost worthless as witnesses in their own defense.

Good luck if Trump loses in November.
I think it'll be worse if Trump wins.

The left wasn't doing this when Obama was in office. They had their guy doing/supporting their ideas. They were getting their way legally. They're not able to do that as easily with Trump as the President, so they have to resort to this. If Biden wins (and especially if the Dems were to take the House too) they wouldn't be violent, because "their guy" would be in power and they'd believe (whether they're right or not) that he is going to do things their way.
Everything depends upon execution; having just a vision is no solution.

Performance and performance alone dictates the predator in any food chain.

That's not a public sidewalk you ****ing tard. It's their property, i.e., they are criminally trespassing. Who is paying you to be so disingenuous and stupid?

If this was Texas, all those "protestors" could have taken a .223 to the head and it wouldn't be illegal.

I'll wait for the copypasta "legal" reply that PROVES these were just a bunch of engineers and doctors going for a leisurely stroll before they were threatened by some evil white devils.

These people have proven time and time again that they ARE a threat regardless of what they may have been doing at that exact moment. With the flip of a switch they can go from being peaceful (LMFAO) to burning down their house.

If you're out to peacefully (LMFAO) protest, you don't need to open up a gate to a private area. The only reason to is to stir up trouble.

Quit being a fuking ******* and defending protesters.

You think they drew the line at wacko commie attorney generals? No, they appoint wacko commie judges too. The law as it is written is a product of WHITE SUPREMACY, and it is their duty to subvert it and pursue some other kind of imaginary cosmic justice by crushing the rich white people.
