Nah, she can just claim she was dazed and confused after suffering a massive blow to the head. At that moment all she could think of was that she was about to be killed in a parking lot. Any good decent lawyer would be able to argue her case. Which charges probably wont be pressed regardless.

Not necessarily, for one a decent amount of CPL holders have one in the chamber at all times, and she/he could easily say that they were dazed and confused.
