Serious question-

In a general scenario, can you legally shoot someone for spraying mace at you? Not talking about some insane, getting swarmed type of thing but one on one like this. If someone sprays me with mace can I shoot them and get off in self-defense.

My thoughts are no.

Dude, I suggest you watch the actual video and don't listen to the news. Kyle was getting swarmed with multiple attackers, was assaulted with weapons and was facing armed attacker holding a pistol. He was on the ground and subdued and they decided to mob him.

michelle malkin has a thread on this with another pic just prior to the shooting. Looks like the guy who died may have slapped the shooter before backing off and getting into the mace vs gun standoff.



That seems like it would imply the dead guy was retreating by at least 4-5 feet before getting shot considering his proximity to the fence post with the sandbag

Looks like shooter may have been reaching to grab the mace and that's why he was slapped. Regardless, guy who got shot was clearly retreating backwards and the gun was already drawn and pointed before the mace was even fired. Not that mace warrants deadly force either, but yeah the shooter is fukked. Not even close to a Rittenhouse where Rittenhouse was being chased, shot at, and the guy was trying to grab Rittenhouse's gun when he fired.

And yes like everyone else said, shooter has a space invaders tattoo which Antifa has used. Will be interesting to see if anything else comes out that links him to Antifa. Either way, looks like he was way quick to fire and will probably end up going to prison.
