Going to be pretty hard to defend having drawn your weapon on a person who had mace out, and then shooting a person who maces you. Pretty hard to argue that mace is lethal and you felt in fear of death or serious bodily injury.

This will trickle down too, Washington Post is reporting that the employer is responsible for ensuring their security guards are properly licensed. Whether that's 9News or Pinkerton (I'd assume Pinkerton), definitely feels like the repercussions will go beyond this chithead hopefully being locked up for a long time

I just look on /Pol. Despite what you'd think of them or see on that board it does have some useful info the likes of which you will never see here.

pinkerton apparently didn't claim him either but it seems they have a habit of doing that, hiring guards under third party "contractors" to avoid exactly this kind of liability

Additional pics in sequence at the site below (more at the link) . . . still some gaps and missing angles that might be helpful, but it looks like the shooter went hands on to impede the victim and wasn't reaching for something the victim had. Shooter was touching the victim before the slap made contact. In realtime, it was probably pretty simultaneous looking.

But the shooter looks to be grabbing his weapon from appendix carry before the victim raises the spray.

i think specifically in denver mace is dictated as non-lethal

i get what you're saying though, the kind of push-pull of the escalation.. if the push being met by a slap is equal, is the pistol draw valid when the only other thing present is the mace? or is the mace the self-defense to the pistol draw? like who's defending themselves at that exact moment?
