Even though many individuals get away dressed like that at the beach, I think the cops were in the right. There is no doubt a precedent set regarding what is considered reasonable and unreasonable attire at the beach. What the girls were wearing could absolutely be considered lude, and sexual in nature.

I don't agree with the accused's literal interpretation of the law. They think they've got a point, but how it would actually be implemented and policed, would be different. I have no doubt they've charged others before with similar pieces of clothing, hence setting a precedent.

What we need to ask ourselves is, at what point is swimming attire considered sexual in nature? Using the accused's logic, would it be okay if she swam with nothing but tape covering her breasts and vagina? At a certain point a piece of attire becomes too small to be considered acceptable.

I made an error in the title - they got detained, not arrested, nor charged.

They were subsequently let go, given they left the beach, which they did.

The cops simply responded to a call - a complaint from another on the beach. I'm sure they'd rather spend time doing other more important things. They don't want to get in trouble by ignoring the call and doing nothing.
