The article says that the event took place at a night club with the girl and he had known her for years.

She was 15 at the time and he was 31.

Theres no information regarding if he actually did anything that would be considered inappropriate if she was 18+

No forced rape or anything just that he was trying to hook up with her.

Department of Defense even views people under 16 as -not- adults even if they're combatants.
