Sorry but they both squared up to fight as mutual combatants. Neither should get charged unless the neighbors reported a disturbance. And in that case the correct charge is fighting/causing a disturbance.


I'm not sure of the law in that state. But here the statute for striking someone specifies the unwanted touching of another. If you square of to fight someone that's not unwanting touching.

That's not even remotely true. if I square off with someoneclaiming to defend myselfI do not want to be touched. If I can knock them out without getting hit, that's my preference. If I can sidestep them and they trip and knock themselves out, even better. A reasonable victim did not want to be touched by the other person

The guy with a brain bleed (which would qualify in many states as maiming, battery, assault, grave bodily injury), could testify that he wanted an apology, not a fight. He got shoved first. Then he got KO'ed

There is legit no winner here. I don't think Fred Durst SHOULD get charged, but he could, and the legal fees even with an acquittal changes your life forever.

There is a big difference between defending yourself and squaring up to fight. Neither party in that video were trying to prevent an altercation. They were both running their mouths, fists up, advancing on each other for a mutual fight.


The only charges that would stick in my state would be disturbing the peace by fighting. And it would be on both parties. You can try to hit the guy who landed the punch with a more severe charge initially since he hurt the other guy. But even a public defender would get that charge thrown out. You can't fight with someone then when you lose try to pretend like your the victim of an assault.



I don't know what kind of legal experience you have but I do this for a living. Only an idiot would buy that he wanted an apology not a fight. And judges aren't idiots. I've spent a lot of time in criminal courts. Where I live that's how it would fly. Both parties pay fines + court costs. Guy who got injured can sue the other party in civil court for medical bills, but its a toss up if he'd win.

clearly, they both wanted to put hands on each other. neither of them was walking away.

even when the white guy shoved the black guy, the black guy STILL advanced. black did not walk away, so it is fair to say they BOTH should be charged. ( or neither)

There is no evidence white would've chased after him after the shove.

I recall that. There's video footage of it - this girl at the party was going around just aimlessly punching dudes in the back of the head. The one guy immediately turns and decks her, and in his defense he didn't even know it was a girl punching (not that it should matter) and reacted with instinct.

Anyways, the girls neck & brain are permanently fukked, and the girl's mom went to the media complaining that it was still the guys fault.
