Olivia Munn (actress) sued after roof tradie accident at her home - who's at fault?

Cliffs:
- Oliva Munn and mother hire alleged unlicensed contractor to replace their roof.
- The contractor 'Fernando' hires Celso Merida to do the job.
- Celso Merida falls off roof sustaining injuries he later succumbs to.
- "The man's (Merida's) family also claims Olivia and her mom instructed him to work on the roof, even though the required safety guards and fall protection were not in place ... creating what the family claims was an unreasonable risk of injury."
- The actress and her old mother did not give proper tradesmen tools to the tradesman (alleged) Merida, lol wut?

Personally I'm leaning to them not being at fault because these adults presented themselves as capable of doing the job, and Merida willingly took on the job and got on the roof without safety devices in place, which if they were to be in place would have been provided by the original contractor or himself.

But then the way laws are framed they may still be found at fault - possibly on the unlicensed technicality? Or the home owners might just pay them something to settle it.

Hiring a non licensed contractor for certain things will get you house condemned right quick.......code enforcement, HOA ,historical society etc etc.....depending where the house is and all that chit......

Also, home owners insurance will take the lawsuit, not Munn

Insurance coverage always depends on the fine print I would think big maybe on that. If they even have insurance which they likely would but it's not a given.

Couple questions what the **** are fall safety guards? I've worked on a roof before but it was my mothers own house and it was 3 floors and a above ground basement and what safety measures could i have taken besides don't fall? And how is Munn responsible for providing tools? The family should be suing the contractor who sub contractored to dude

Roofers typically aren't tied off and don't require other fall protection. One of the few trades who is allowed to do that because they are supposed to be trained for it.
Tradies are responsible for most of their own hand tools, and power tools are provided by the contractor, typically.

Verdict, Stupid tradie takes on job he can't actually do (happens more than it should), falls off roof and dies. Family is trying to get dat dere actress money.

As far as a licensed contractor goes, do we know if Munn actually knew they were unlicensed? Most people don't do their due diligence on verifying a contractor is licensed. Also the tradie doesn't have to be "licensed"

you're technically supposed to like, make an anchor at the roof's point or something that you can tie off to and wear a chest harness with a rope that would catch you from falling, but i have literally never in my life seen any type of roofing contractor actually tying off, they just wear the harness in case the city shows up so it looks like they're tied off

not sure why a celebrity is hiring an unlicensed contractor unless he misrepresented himself though, family just knows they were working on a rich person's house and the lawyers see dollar signs here..

There are fences which can be installed around the edge, and also the worker can use a rope/harness system built for that purpose.

Yeah we use the term 'tradie' a bit too loosely. There's certified pros, electricians, plumbers etc, then there's some guy who takes on building jobs. This looks like the latter.

some houses have no fire places.. where you tying up. but yeah i will agree why a "celebrity " was trying to cut corners to save money or she could of just been completely unaware that the contractor was sub contractoring. to someone who might not have the exp... but it provided them the most profit

"licensed" is not really the big deal. Typically licensed andinsuredis what matters most. Specifically for cases like this and if the work is faulty leading to property damage.
