What state is this? makes how interesting this case is gonna be.. cause if he told you to get off his property and you don't and get confrontational. Your looking for trouble and if you have joint custody going to your baby moms house and starting a scene is not gonna look good in any court.. should went when problems started went back to his car and call the cops

i think the guy was stupid for ever going and getting the gun. i mean using the same logic the bio dad could have called the cops they could have done the same with him on the property. if the dad showed a weapon, i'd agree with getting the gun

i guess i agree with him shooting him. because he was trying to get the gun. now, maybe he was just trying to take it away but imo you can't risk he grabs it and then shoots you. but again, guy was dumb for ever getting a gun involved

does the bio dad have a right to be there even if was his kid? there are prob different property and divorce laws. though it kinda sounded like they didn't have a split agreement, prob just word of mouth based on what the bio dad said about taking them to court

so does he have a right to be on the property? prob not. does he have the right to custody of his kids? probably. im guessing they'd say the solution is for the bio dad to call somebody

were they hiding the kid?

Once people truly realize what escalation means, that's when we see less violence. But many don't really understand it's true meaning. The dad's death didn't have to be if the shooter didn't get the gun.

could come down to property vs. custody laws

is he allowed to be on the property? prob not

is he allowed to be on the property if they are physically hiding his kid on the property?

if somebody kidnapped your son are you allowed to go on their property to get them back? or do you have to contact law enforcement to get a warrant to search the property?

I'm not sure on the state castle law or lack thereof, but I do know you should be able to arm yourself in whatever form you want within your own house. I'm not sure if provocation would be able to be charged if you had picked up your gun/pulled it within your own house? Pointing it at someone? Sure, but just having it on you shouldn't fall udner provocation WITHIN your own house especially when you have a person on your property refusing to leave and seemingly upset.

Doesn't matter if they had the kid there and were "hiding him". The dude said the kid wasn't there and he didn't know where he is. The guy apparently had no clue where his kid was, so he has nothing to say the kid is there.

EVEN IF the kid is there, in custody disputes, it always goes to the police, who then tell them to go to the courts and police usually wont do **** w/o a court order. So no, he had no right to do ****. Also no its not 'kidnapping' if the mother didn't return the kid at the specified time to the other parent. It's her breaking the custody agreement which he should then take to the courts.

Not how the law works. You have no legal right to be there once the legal owner asks and then tells you to leave. Doesn't matter what business you think you may have on the property. When the guy told him to leave, he should have, then called the police explained the situation and they probably would have shown up asked the couple wtf is up and that hes here to get his kid and figured out what was up. If she said she wasn't giving him back they'd have told the dad to go to the courts.

Well, we'll have to agree to disagree. I don't think this was a good shooting.

The father had a legal right to be on the property. I don't think it's a good standard to allow someone to produce a firearm in a custody disagreement and order the other person to leave.

I could see it being reasonable if the father acted threatening or had gone inside the house. But this... was like surreal chit. It's weird how everyone talked calmly in the video after a man had been shot and killed. It almost doesn't seem real.

No one freaked out because the shooter killed the guy "cleanly". It wasn't a freak accident. Hell, I don't think the guy is even arrested yet. Mass shootings over the past couple of years and nothing has changed about gun ownership.

All this really is, its a sacrafice to protect US gun laws. Americans know they need the guns to protect themselves from the upcoming civil war and shift in land ownership.

i posed a hypothetical scenario. i said it might not be the details of the case. was legit asking a question within what i was saying

like i said.. if you know somebody kidnapped your son but its their property do you have to get off their property? that would mean someone has your property on their property correct?

what if somebody stole your stuff and they took it on their property?

now, i would imagine that the law says you can't be on their property but there may be little nuances.

you take issue with the hyperbolic "kidnapping" but i'm just trying to see if there's any way a defendant can get on their property; e.g. kidnapping or stolen items. i would think typically when a homeowner says "go away" they have grounds in their reasoning, well, what if the person has reason to be there

also, do we know for definitive fact that the property was indeed the guy who shot? or is that something that may come to light if they decide to pursue it civilly?

i also personally don't know the custody agreement

ok, what i thought. so it looks like if he is the property owner he gets a lot of leeway. but i figured there was SOMETHING. saying he could be there. if it's that difficult for people to get their chit why wouldn't any landowner just go steal a bunch of chit and put it on their property? call the cops but what if they're *******s and ask for proof of ownership and whatever other loopholes that may involve it

looks like there's something called the "right to self-help". which gives him a little more leeway for being there

There is also something called the right of "Self-Help." For example, the repo men use "self-help" when they go to someone's house in the middle of the night to repossess a car that the buyer quit making payments on. So, theoretically, you can go to his house and retrieve your truck, as long as it does not involve breaking and entering, or damage to his land or property. However, you run the risk of a physical fight with him, being shot at, or him suing you for trespassing and damage that he will claim you caused to his land when you drive (or tow) your truck out of the woods.

but it sounds like property owner can still act the way they want to act. but i think that then gives more credence to the escalation of the confrontation.
