The way the article reads, it sounds like the black kid was just one of the athletes wandering around in the middle field, not a part of the race and was actually getting on the track and getting in the way of the lead runner. It says he was in the way one lap, and then the next lap got in his way again and so white kid pushes black kid out of the way, and black kid chases him down and punches him.

So they are suing the people hosting the event as well for not having people properly managing the track to keep people off.

There was allegedly an altercation before the attack, where the victim had told the attacker to move out of his way. When he refused, during an earlier lap, the victim had pushed him, according to TMZ.

At the time, Osceola County Sheriff's Office claimed that the victim, who has not been identified, had not wanted to press charges, but his family have disputed that claim, with their attorney telling the outlet that their son would have been arrested for battery had they filed criminal charges.

I'm reading between the lines a little...

obscuring is an odd choice of word, it makes me think he wasn't supposed to be on the track and was probably partially on the closest lane to the center where the lead runners usually stay to have the shortest turns.

Here i imagine the lead runner passing a particular spot where the black kid was in the way telling him to move one lap, and then next lap around shoving him out of the way off the track. Also black kid had huge burst of speed and energy like he was still pretty fresh and hadn't been running in this mile long race.

again this lends itself to the above scenario. Proper officials wouldnt stop the black kid from holding the closest lane if he was in the race, but they would prevent people from getting on the track who shouldnt be there

The example you've given is EVEN WORSE than what has happened in the video here.

A thief tries to steal some meds from a pharmacy and a third party bystander shoots and kills the thief. Talk about overboard. Now the third party bystander will likely be arrested and charged with manslaughter or whatever lol

Not really. Just shows the suspect was intentionally putting himself in the runner's way on an earlier lap. It's not like they had a shoving match in the parking lot. It was literally on the lap just before the one shown that it happened.

Not sure here, some cops are pieces of chit. My SIL had her car crashed into by a clearly drunk driver. She lives in podunkville and there, apparently owning a gas station makes you a pillar of the community. The sheriffs who showed up did not write him up for being intoxicated and he was drunkenly saying for her to not file with insurance and he would buy her a new car (yeah right). To wit, the chithead sheriffs were saying she should do that, as if it was any of their fuking business. There were two, one started getting hostile with HER and yelling at her and had to be restrained by the older cop who set him aside. I wasn't there but she isn't the type to lose her cool or instigate a stupid fight with a cop, he must have been a real dickhead.

Sounds like they have the option to pursue prosecution but the cops have said they will file against the white kid too (did they even receive a complaint from the jogger? <- correct use he was jogging).

They could always call the cop's bluff and insist on prosecution in which case the judge and evidence presented will determine who's guilty of what, not the cops.
