My guess is that you are not thinking straight.

The law in most states is that if you are going say 40 in the passing lane, you are blocking traffic.

YOU CANNOT EXCEED THE SPEED LIMIT BECAUSE THAT IS THE LEGAL SPEED LIMIT.

So, it is not legal to break the speed limit when passing.
Even if you live in Texas or another state with prima facie speed limits, you can get pulled over for speeding to pass another car when it’s not necessary.
