No, the crime is that he allegedly committed some kind of fraud by listing the $130k as a legal expense. That charge is a misdemeanor, but it gets bumped to felony because he allegedly did so in commission of another crime - campaign finance violation. The campaign finance violation is a federal charge, and the feds refused to go after Trump on it, which is the biggest hole in Bragg's case (and why people say it won't work in the end).
