A federal judge has struck down a Tennessee law that banned drag shows in public or where children could watch them is unconstitutional, writing that the measure was passed “for the impermissible purpose of chilling constitutionally-protected speech.”

U.S. District Judge Thomas Parker, who was appointed to the U.S. District Court for the Western District of Tennessee by President Donald Trump, had issued a preliminary injunction at the end of March to block the law from taking effect. In that ruling, he agreed with Friends of George’s, a Memphis-based theater group that produces drag and other performances, that it was too broad.

In his ruling issued Friday, U.S. District Judge Thomas Parker wrote that the law violates First Amendment freedom of speech protections and was “unconstitutionally vague and substantially overbroad.”

The law, which Tennessee Gov. Bill Lee (R) signed in March, would have criminalized “adult cabaret entertainment,” punishing first-time offenders with misdemeanors. Repeat offenders could face felony charges and prison sentences of up to six years if convicted.

Drag acts are not inherently sexual or age inappropriate. Ever seen Christmas pantomime for kids? Whole thing is just actors in drag.

The left is just going to use the courts to normalize this chit just like they did with gay marriage (remember, gay marriage failed on the ballot in EVERY state it was tried including California in 2008!).

It may be that this law was just poorly written.

But restricting things by age is a long standing state right- sex, driving, marriage, etc.

And if twerking and pole dancing in front of children is free speech then they better get the hell over demonstrations at abortion clinics or people lining up to boo and wave signs at various parades and events.

The judge's conclusion states the law needs to be narrow and well defined, but it's up to the legislature to do that, not the court.

The thing is, TN already has obscenity laws that cover live performances and minors, if they rewrite this one to be narrow an well defined it will more or less just duplicate what they already have.

Which brings us to the obvious that this was just meaningless political theater. State legislatures know how to write laws when they need to, and they know how to play games when they want to.
