Jack Smith's Grand Jury Not Told About Clinton Socks Case or Presidential Records Act

Jack Smith Did It Again! Grand Jury Not Told About Clinton Socks Case or Presidential Records Act

THE CURIOUS HISTORY OF JACK SMITH

From 2010 To 2015, Smith Served Under Obama’s Attorney General, Eric Holder, Leading The Public Integrity Section. “Smith served under Obama Attorney General Eric Holder, leading the DOJ’s Public Integrity Section from 2010 to 2015. Smith led a team of 30 prosecutors in conducting public corruption cases throughout the United States, including a mixed track record of going after high-profile politicians. He also inserted the DOJ into what would become the Lois Lerner IRS scandal targeting conservative nonprofit groups during the Obama years, which Trump has criticized him for since he became special counsel.”(Washington Examiner, 6/5/23)

After Leaving His DOJ Post In 2015, Smith Served As The First Assistant United States Attorney And Acting United States Attorney For The Middle District Of Tennessee. “After leaving the DOJ in 2015, Smith headed to Tennessee, where he served as the First Assistant United States Attorney and Acting United States Attorney for the Middle District of Tennessee.” (NPR, 11/18/22)

President Trump Is Not The First Republican Executive Smith Has Over-Prosecuted

Smith Prosecuted Republican Virginia Governor Bob McDonnell, Whose Conviction Was Unanimously Overturned By The Supreme Court.

Smith’s Prosecution Of Former Republican Virginia Governor Bob McDonnell Failed, When His Conviction Was Unanimously Overturned By The Supreme Court. “Smith’s DOJ biography in 2015 touted that while chief of the Public Integrity Section, Smith helped with the prosecution against McDonnell, who was indicted and convicted on federal corruption charges related to bribery in 2014. The case was being prosecuted by Smith’s deputy in the Public Integrity Section. McDonnell was investigated while governor, indicted shortly after leaving office in January 2014, convicted in September 2014, and sentenced to two years in prison in 2015. The Supreme Court unanimously overturned McDonnell’s conviction in the summer of 2016.” (Washington Examiner, 6/5/23)

Jack Smith Is Married To A Left-Wing Movie Producer And Joe Biden Donor

Smith Is Married To Katy Chevigny, A Producer Of ‘Becoming’ A Documentary On Michelle Obama. “The wife of newly appointed special counsel Jack Smith is a filmmaker who produced a movie about former first lady Michelle Obama and donated to President Biden’s 2020 campaign. Katy Chevigny is credited as a producer on ‘Becoming,’ a 2020 documentary about Obama, and Federal Election Commission records show that she donated $2,000 in support of Biden’s presidential run that same year. “Becoming” centered on the former first lady’s 2019 book tour promoting her memoir of the same title. Big Mouth Productions, where Chevigny is employed as a director and producer, is listed as one of the production companies that worked on the film.” (New York Post, 11/23/22)

Chevigny Contributed $2000 To The 2020 Biden Campaign. “Federal Election Commission records show that she donated $2,000 in support of Biden’s presidential run that same year.” (New York Post, 11/23/22)

On Wednesday morning The Gateway Pundit spoke with two attorneys who gave us the same explanation. Jack Smith did not tell the Grand Jury about the Presidential Records Act or the Clinton Socks Case because he didn’t have to.

Both of these cases exonerate President Trump. Jack Smith did it again. How does this guy keep a job? It appears Jack Smith may be the only liar here.

Why would Jack Smith not disclose any of that information to the Grand Jury?

Very standard for grand jury indictments as I understand it. The prosecution gets to make its case to the grand jury and leave out whatever they want. The person being charged doesn't get any input at all.

This is extra-hilarious if you consider the grand jury process was created as a shield against malicious prosecution, now the prosecutor uses the grand jury as just another tool in his toolbox.

How often are prosecutors held accountable for Brady violations?

Brady was decided in 1963 and has been violated ever since.
Again.

This is correct. The trial jury will get to hear Trump's defense as well as the evidence against him. The grand jury only hears the prosecutor's side in order to determine if an indictment is warranted at all.

Regardless, Trump won't get off because of the Clinton case. They're totally different, and the charges were brought under the Espionage Act, not the Presidential Records Act anyway. In other words, the crime is not just that Trump had classified documents, but also that he was showing sensitive national security documents to unauthorized persons, which he is on tape admitting to.

So an indictment of a leading presidential candidate is probably irrelevant and likely malicious.

No. If there is enough evidence that he has committed a crime that a grand jury recommends indictment, then it is neither. That's how grand juries work.

That judge made rulings in regards to the presidential records act. She actually went an additional step to say NARA has no authority to label the material presidential records and retrieve them.

The good news for the TDS crew is that we're now in clown world so precedent and the law aren't really a factor.

That's not the allegation against the Espionage Act. The allegation against the Espionage Act is that the documents wereclassifiedand shown to people without proper clearance, and there is a recording of Trump showing the documents to a person without proper security clearance AND admitting he didn't declassify them as President and can't after he left office.

1., The Clinton socks case is irrelevant to Trump's situation. It was determined that those recordings were personal records, not official presidential records. This makes them not subject to NARA.
2., Even if Clinton had broken some law, which he never did, not once, that has nothing to do with Trump. Clinton's actions have no bearing on the choices Trump made nor are they evidence in Trump's proceedings.
3., The Presidential Records Act actually works against Trump, but he's an idiot and doesn't understand that. It makes all official documents and records to be the property of the people, not the twice-impeached president who lost the popular vote. "Establishes that Presidential records automatically transfer into the legal custody of the Archivist as soon as the President leaves office."

Moreover, the way I understand it, many of the documents that Trump illegally stole and tried to hide in his Florida tenement did not belong to the office of the president but to other government entities such as the illustrious CIA, the Department of Defense, etc.

You just admitted the grand jury only gets what the prosecutor gives them and that he can withhold information from them, the goal of a prosecutor is to prosecute(even if it shouldn't be) so it's not farfetched to think the prosecutor unfairly colored the grand jury to indict, prosecutors do it all the time.

The same National Archives that refused to help Trump with his transition from the White House?

The indictment is not unfair if there is enough evidence to bring charges and go to a jury trial. There apparently was in this case. An indictment is not a conviction.

They were declassified though, so no clearance was needed. That's what is explained by the clinton case. The documents were declassified by the simple act of taking them home rather than giving them to the archives. Nothing Trump says to anyone after leaving the white house can change whether or not anything is classified. He can just say he was lying to try to impress the reporter, which given that it is Trump may actually be true.

Why do you defend our current grand jury system when it was originally meant as a shield against malicious prosecution?

Prosecutors can indict anyone they want with the current grand jury system.

They can also force the grand jury to no bill.

Clinton's transgressions are not evidence in the case against Trump.

Nothing weird about that.
Does that somehow excuse him stealing documents that do not belong to him then showing them to people who do not possess the required security clearance for them?

Why do you lie? Not all people on this site are as stupid as you are. Some are, but most are not. The Clinton case has nothing to do with classification. It has to do with differentiation of personal records and items that belong to NARA. Moreover, there is the audiotape of Trump admitting he did not declassify the documents. In fact, some of the documents recovered from his residence in Florida were documents that even the president does not have the authority to declassify.

If your position is that a document immediately becomes declassified simply by virtue of the twice-impeached orange president stealing it from the White House, please cite the statute or case law where that has been decided. I will bet all the money I currently possess that you will not do this, however.
