How should I fight my ticket?

Got pulled over for not wearing a seat belt

Op admits fault to not wearing a seatbelt but does not admit fault for being pulled over for simply not wearing his seatbelt. There’s a reason why it’s a secondary offense in many other states

It does matter that’s why the court takes into account other cases even decades ago

There’s a reason why they do it that way in other states

In my state they can pull you over for it, but that in lies the argument that they shouldn’t be able to

Like I said I can agree with a no seat belt fine but you’d have to pull me over for something more serious otherwise fk off

Eh, you kinda goofed missing the court date. They're less likely to care about counter arguments or a contest of a ticket when you miss court dates.

They probably don’t even realize I missed the date since they already have other trials. All it is is a new court date for the same issue

I’ll go and quickly present my case and if they don’t simply drop it then I’ll have no other choice but to pay the fine

I never wear a seatbelt, but have tints on my car so a cop can't see whether it's on or off. If you have tints, you can make this argument. Idk what state you're in and your tint laws. You could probably even get legal tints before your court date, take pics of your car and make that argument. I highly doubt there's documentation on your ticket stating your tint status. Just show the judge a picture of your car with your license plate included as proof. (Super Ded fkn Srs)

I had my windows down and he was fairly close by so he clearly saw me without my belt

But arguing tint wouldn’t be in my favor since the judge would look down on it

really depends on the state, but having a tint so dark that they cannot see (especially if you're driving around in a rice mobile) is reasonable suspicion to pull you over just to check if your tint is legal.

Right, but if your tints are at the legal limit you can make the argument that the cop didn't pull you over for not wearing your seatbelt since he cant see. A legal tint you can sort of see through, but not enough to tell if one is wearing a seatbelt or not. OP stated his reason for being pulled over was the cop saw him not wearing a seatbelt. Thats a bit of a stretch though.

For example, here's a more extreme scenario; If they pull you over for speeding, and find meth in the car, according to your logic they're not allowed to cite you for having meth because they pulled you over for speeding.

That's not what I said at all. All I said was how can a cop pull over OP for not wearing a seatbelt, if the cop cant see his seatbelt through tints.

It will still be the cops word against his. All the cop has to say is;"I saw him driving without his seatbelt"How is he going to prove otherwise?

dont fuking matter.the cop probably pulled him over for the tints in the first place.thats probable cause right there.maybe the tints werent illegal afterall but that cop was gonna find something.you are not gonna beat that charge unless the DA decides its not worth his time to fight it.id just pay the ticket

They threatened me with that if I dont show up on the second court date but why am I the idiot here because I was pulled over for something minor and then threatened to have my license revoked for not wanting to show up

This thread makes my head hurt. Cops don't need probable cause to pull you over, all they need is reasonable suspicion, which is a lower standard than probable cause. They need probable cause to conduct a warrantless "search" and potentially violating your 4th amendment rights.

OP, just hire a lawyer. They may be able to get it brought down. This is not legal advice.

Seeing as I am from Norway, I have no real knowledge of US laws and the differing laws of different states. But as a masters law student and grown up adult, here is my take:

- Did the police pull you over out of nowhere? In Norway, the police can pull any car over for "routine controls", which means they need absolutely no reason at all. This might not be the case in the state in question, however the question then becomes, were they doing a traffic control of sorts? To cut to the chase - do you have any real legal argument for their stop actually breaking any laws? Arguing your ticket from a normative standpoint is totally pointless.

- If you are serious about getting around this ticket, the obvious choice is to engage a lawyer who specializes in this. I've heard that in the US, hiring a traffic ticket specialist lawyer can be quite lucrative.

Hire a lawyer who has connections with the court srs.

My guy charges me roughly $400 and the ticket goes away every time with no points. Gets downgraded to faulty equipment.

Again, I can agree to being fined for not having a belt on but you cannot pull me over simply for it. This negates the ticket altogether you can’t cause more harm then good when trying to enforce that law

If it's a primary offense in your state there's unfortunately no way to fight this totally ludicrous and unconstitutional "regulation"

It's shouldn't be any points on your license. You're not gonna pay a lawyer at least $250 to fight a $150 ticket (or w/e it is), and you're not convincing a judge that the regulation is unjust and he should drop the charge to something lesser (or nothing at all).

Just pay it and move on.

That’s why I’m fighting the ticket rather then just paying it outright

If you don’t make a complaint, even if I lose, they’ll keep doing what they’re doing

The ticket is around $30-$45. It is was $10, I’d paid it off long ago and avoid court

You'll be wasting your time showing up to court over a traffic ticket. Judges don't throw them out easily. The fact that you're allowed a hearing in court over them at all is nothing more than a procedural formality unless you have a really good case, which you probably don't.

1) In what scenarios is it illegal for an officer to pull a car over? If similar legislation as in Norway, they don't even need a reason.
2) In this case, they have a reason - they observe a traffic violation. I would assume that they can pull you over for not wearing a seat belt for the same reason they can pull you over for not yielding for traffic.
3) Arguing your ticket from a normative standpoint is pointless because the judge will be judging based on the law as it is - de lege lata, not how you or he thinks the law should be - de lege ferenda.

Again I must add that I am not familiar with US law and I know the police and the judge is, by European / Norwegian standards, given a lot of discretion. But my point is, I believe it is very likely that the police could legally pull you over in this scenario and give you the ticket. If this is the case, you would need some sort of statutory provision for why you the ticket is illegitimate.

1 here in the US officers need to see a violation in order to pull you over or they can be sued
2 the violation here was that I wasn’t wearing my seatbelt
3 that doesn’t mean he could or should pull me over because of the type of violation because he has to juggle between the violation and the use of force
4 all laws and or policies are based on what one thinks it should be

With some states having seat belt enforcement become a secondary violation, it has already laid the foundation for why I believe the ticket was illegitimate

You can always argue and move policies because what is policed is limited because they have a finite amount of resources
