McDonald’s sued for ‘severe burns’ from spilled hot coffee — again

A San Francisco McDonald’s is being sued after a woman in her 80s allegedly sustained “severe burns” from a scalding cup of coffee and was refused help by store employees.

According to Childress’ lawsuit, the incident occurred earlier this year on June 13 at 1100 Fillmore Street in San Francisco. The lawsuit claims that the coffee cup lid opened when Childress attempted to drink from the cup and that “scalding coffee poured out of the cup,” causing severe burns and scars to her groin.

Childress says in her lawsuit that she attempted to report the incident to three employees at the McDonald’s location, including managers. The lawsuit claims that all three “ignored” and “refused to help her” until she ultimately left to seek treatment for her injuries.

Childress’ attorney did not immediately respond to TODAY.com’s request for comment. In a statement to local outlet SFGate, her lawyer, Dylan Hackett, said the coffee cup had not been “properly” covered and the coffee itself was “scalding.”

“She’s an elderly lady, and she was waiting for over an hour to speak to a manager, and a manager never spoke to her,” Hackett told SFGate. “They didn’t give her the time of day. … Nobody helped her whatsoever. She had to get to the hospital herself.”

Childress’ court filing lists the action as an unlimited civil case that could exceed $25,000.

Daily reminder that the woman who first did that was severely burned with 2nd and 3rd degree burns covering a relativly large portion of her body. This was the result of the company practicing unsafe techniques which IIRC, violated their own policies.

Afterwards, MCD went on the campaign trail to ensure the population "knew" the lawsuit was frivolous and unwarranted, and holy chit look how that turned out.

That anecdote is literally the go to example when discussing frivolous law suits, but as it turns out, was absolutely warranted.

Her truck didnt have cup holders and she held the cup of coffee inbetween her legs with her knees, which would be very easy to squeeze too hard making it splash out. If you hold a hot coffee inbetween your legs in a moving vehicle youre a dumb ass. McDonalds also served it at the same temperatures of 185 degrees as they do today. She spilled it on herself taking the lid off. The 185 degrees is a standard temperature for hot coffee and her family got 2 million because there wasnt a sign on the cup to say the hot coffee was hot.

the lid she received was defective and had been recalled but that particular franchise didn't pull their defective lids out of service.

the coffee machine was also malfunctioning and producing coffee 20-30 degrees hotter than it was supposed to and McDonalds already serves their coffee 10-20 degrees hotter than anywhere else did in that city

That is impossible, they say the standard is 185 degrees, it cant be 40 degrees hotter than the standard or it would be boiling.
