I study English Law at a top 5 uni here in first year. From what i know, this is a civil matter, in this case it is very unlikely that she will even have the resources to mount a legal challenge, fairly impossible i'd say.

Regarding article 8, the hra is only applicable (i am quite sure) when it is a public body infringing an individuals rights.

American law is BASED on British law you guys. We are MORE protective of speech. England is LESS protective. It is WAY more likely that disseminating a video of a private act is actionable both criminally and civilly.

No. Because it needs the government to designate it state functions. The only way in which it could be a public body is if its a hybrid public body (a private body performing both private and state functions), whereby the government contracts it jobs the state is meant to provide (e.g. contracting out private nursing homes for state programme use).
