Probably the solution will end up being ending it but giving amnesty by way of an easy path to citizenship to those already here under those circumstances if they qualify.

I would argue keeping them enslaved for 250 years effectively leads to the same outcome.

I care, kinda. The basic point was we got to where we are as consequence of our past behavior, which wasn't that great.

And all Senator Jacob Howard had to do was be more fookin' specific with the actual language of the amendment and things could have turned out a little different. It's hilarious that he goes on to queef about how it will remove all doubt as to what persons are or are not citizens when here we are examining it again.

I don't think the US is capable of making such a drastic change at this point, and if they try, guaranteed the government will fuck it up far worse than we can even imagine.

Trump will loose this- but it's because he's using an EO

The question will be is the Supreme Court going to acknowledge that Congress can actually do this and the 14th application isn't what people think it is.

If the Supreme Court goes that way in - then the ball is in Congresses court (right now Congress perceives it isn't)


I think it will 5-4 or 6-3

Trump loosing his eo is almost a certain- but the congressional ability for this is what's crucial for the case- and while bringing it, this way was important.

This will make a congressional move plausible- where right now it's impossible.


The Supreme Court could also just flat out strike it down because it's an EO over congressional statute and not even mention anything about the 14th.

The SC intentionally chooses not to clarify anything though. They punt to congress to do the job they are supposed to do and I don't see that this case was needed to enable congress to act at any time. Like the exclusion for diplomats you pointed to, congress already has the authority to interpret the 14th and revise the law. If congress acted we could then get actual clarity of the law and what the amendment actually applies to, because it was done the right way, instead of with the ineffectual and gay EO stuff.

The underlying reality seems to be that no one but Trump wanted this.
