Misc real estate bros help me out here

Basically I'm in the process of selling my condo. We were actually going to close 2 weeks ago but the buyer was dragging her feet.
She accepted and offer of 188k. Had an inspection done which came back with a few minor things than I fixed, buyer had quotes done by a contractor to redo the flooring .Condo got appraised for 183k I said ok I will come down to 185k
The buyers response who is also a realtor


Xxxx IJust checked out the email… still in the middle of showings. Listen the more I think about it I just don’t think it’s worth it to me anymore I appreciate your seller coming down on price but more I think about it it just doesn’t
Make sense for me to purchase the condo. I would like to cancel the deal. I’m very sorry.


Do I get to keep my earnest money?
My realtor said she will respond back that I'm keeping it but also said that if she wants it we will have to give it back or go to court

I believe the appraisal coming in low means that you don’t keep chit, especially notyour prospective buyer’searnest money

They just had to waste their own money appraising your place, why should you get to take more of their cash for nothing?

Yes but she did not say she is not interested because it appraised low. She said she lost interest in it.
As far as I know I get to keep it because she wasted 2 months of my time. The place could have been sold by now to someone else

Yes but my realtor is telling me that if we want to keep it we might have to go to court.

The contract says

If this offer is accepted and Buyer fails or refuses to close the transaction,without legal cause, the earnest money shall be retained by Seller for damages Seller has or will incur. Seller retains all rights to seek other legal and equitable remedies, which may include specific performance and additional
monetary damages. All parties have the legal duty to use good faith and due diligence in completing the terms and
conditions of this Agreement. A material failure to perform any obligation under this Agreement is a default which
may subject the defaulting party to liability for damages and/or other legal remedies, which, as stated above, may
include specific performance and monetary damages in addition to loss of Earnest Money.
