PlayStation maker Sony this week rolled out a new software update to allow gamers to record their online voice chats for moderation purposes.
“Please be aware that voice chats in parties may be recorded and sent to us by other users,” Sony is now telling gamers who have strapped on a headset to play with their friends online. “By participating in voice chats, you agree to your voice being recorded.”
The feature will go live when the PlayStation 5 is released next month. Recordings of potentially offensive content can then be sent to moderators to review for violations of the PlayStation code of conduct.
PlayStation’s rules ban hate speech, threats of harm, bullying and harassment as well as “[encouraging] anyone to hurt themselves or someone else.”
It does not appear that users will have to give permission for their audio to be recorded.
Sony’s next-generation video game console will hit stores Nov. 12 — two days after the Xbox Series X’s release — and will retail for $499. The all-digital edition of the gaming system, which doesn’t feature a disk drive and can only play downloaded software, will retail for $399.
Good idea or bad idea? Sounds snitchy to me.

Ngl I love the odd toxic lobbies and people seem to have so much fun with it...obviously racial type stuff isn't great,but otherwise I think people should be able to have some freedom.

Sony is probably giving people a heads up that if you’re straight cyber bullying someone they will just ban your account.
I wouldn’t be surprised if this wasn’t happening before, but now that they made you “aware” of it, they can actually come after you.

In a post on the PlayStation Blog, SIE VP of Global Consumer Experience Catherine Jensen said that the voice chat recording function will be used for players to report harassment while playing games. The most-recent five minutes of a voice chat will be available to players to record and send to Sony's consumer experience team to make a decision.
The notification players see that lets them know they may be recorded is likely a matter of legality. In certain regions, including some parts of the US, it is illegal to record someone's voice without their consent.
"Please note that this feature will not actively monitor or listen in on your conversations--ever--and it's strictly reserved for reporting online abuse or harassment," Jensen said. She added that users will not be able to opt out of this feature in order to ensure that everyone is held accountable if they are being abusive online.

Q1: Is recording being done on PSN's servers/back-end? Or is the recording being done locally by other user's consoles only?
A1: Thanks to clarification provided by the statements from Sony, it is confirmed that recording is done locally on user's PS5 consoles and not on PSN servers. Party voice chat recordings are submitted to SIE whenever a user submits a voice chat report from their PS5 console. Sony does not monitor or listen in on party conversations unless they are part of a submitted report.
Q2: Are pre-existing "Allow Voice to be Shared" party privacy settings honored? For example, can someone only report the audio they were able to record through standard SHARE menu options, or are Party voice chats an exception?
A2: The latest update from Sony has confirmed that it will not be possible to opt-out of party voice chat recording for the purpose of reporting.
Q3: How much audio is recorded? How much can be sent to Sony?
A3: PS5 players will be able to include up to a 40 second-long Voice Chat clip in their report. This will include a 20 second selection by the reporting player, plus an additional 10 seconds before and after the selected region. Only the most recent five minutes of a Voice Chat will be available for a player to use for this reporting function.
Q4: What is the review process? Are bots involved? Is it human review? A mix?
A4: Recordings sent via a report are sent to the PlayStation Consumer Experience team for moderation, who will then listen to the recording and take action, if needed. Some submitted reports won’t be valid, and that will take it as an opportunity to provide guidance and education.
Q5: Can I be suspended for language that technically violates the Code of Conduct but in context with my friends was mutually acceptable by all involved?
A5: This has not been detailed by SIE. Sony's updates however confirm that reporting requires action by a PS5 user, meaning as long as a participant does not report particular voice chat content, it will never be reviewed by Sony.
Q6: Has it been possible for others to record or stream my voice before now?
A6: Yes
When using IN-GAME voice chat, you could be recorded by another player's PS4 SHARE function and saved as a video clip or be included in a broadcast. This is currently possible without your consent.
When using PARTY voice chat, you could be recorded by another player's PS4 SHARE function and saved as a video clip or be included in a broadcast, depending on the "Allow Your Voice to be Shared" privacy setting you have set.
When using ANY type of voice chat (In-game or Party), player's sending their PS4's A/V signal to an external device (such as a PC / capture card) could record your voice to a video file, as well streamed to service (Twitch, YouTube, etc.). This is currently possible without your consent.
Q7: Has it been possible for Sony to review Party audio content as evidence for reports before?
A7: No, this is what is new. While there have been reports there there have always been grounds in the ToS for monitoring voice as far back as 2013, this is likely in regards to Audio Messages which were able to be sent since the launch of the PS4. This is the only other type of audio that has previously been allowed to have been reported prior to PS4 System Software 8.00 & the PS5. There is no evidence that suggests party audio was previously recorded, monitored, or reportable to Sony.
Q8: What consoles / platforms does this apply to?
A8: Per Sony's update, reporting voice chat in parties can only be done from a PS5 console, however your voice can be recorded as part of a report regardless of what platform you are using Party chat on (PS4 or PS5).
