Can you sue the government

If they arrest you off a false tip?

Asking for a friend.

Example:

Police raid your residence off a tip that you are a drug dealer.

Police arrest you, and find ZERO evidence of being a drug dealer and release you.

You are like "wtf was that, I'm not even a drug dealer and I was arrested"

Wat do.

Arrested for no reason and now the entire small community you live in thinks you are a drug dealer. (you are a known business man, not just some random schmoe)

Lol this isnt me. srs.

It's a CLOSE friend though (know him well for 25+ years). Let's just say I know he's innocent because i was always the "bad guy" and he's literally a good boy.

But we are on the same page here, I'm thinking he could sue the chit out of the government because they literally arrested an innocent rich business guy off a fake tip.

He definitely has money to hire a lawyer and sue aswell.

They arrested him. Searched his residence and business. And found ZERO.

So yes, that's exactly what happened.

This guy has a BOOMING business and took out a lot of competition. People don't like his success. srs.

You wouldn't understand lol

Even if he didn't, there are lawyers who would take the case on as 9 times out of 10 it's a tap in and the government get left with the bill for the legal fees.

The police have to record everything they do along with cause etc. If they fukked up there's a paper trail, obvious property damage, an arrest record, etc.

But yeah, consult with legal representatives before doing anything, the Misc isn't the place to get legal advice.

If they raided your house off some random tip that wasn't verified or corroborated, and they didn't bother to investigate and just did the raid solely off the tip, then yes I'm pretty sure you can sue. However, I doubt that's the case. I doubt a judge would even sign a warrant based on a tip being the only evidence.

Well, they investigated and searched everything AFTER they arrested him.

They shut down his business for the day, put him in a jail cell and released him later that night.

This

If they had a warrant then they had probable cause to raid your place. And if they didn't find anything to link you to the alleged drug dealing activity you can shirley sue them.

Also If they broke down your door, destroyed your property, ransacked the place, took a bunch of your personal stuff like laptops and other chit then yeah you need to go ham on them.

But first of all you'd need a competent lawyer who'd be willing to take your case up pro bon, argue it in court and win.
