New laws will make it illegal to film people in public spaces for more than 5 seconds

"Under a federal proposal, it may soon be illegal to film another person or persons either intentionally or unintentionally for a period of 5 seconds or longer. If proved to have done so in court, a person may be fined up to US$100,000 and spend 60 days in prison for doing so.

The proposal is designed to make smartphone users aware of the harm done by digitally recording members of the public, who's lives can be permanently ruined by uploaded recordings.

Youtube and other video hosting platforms may be fined up to $1 million per day from hosting a video containing a member of the public without that persons permission

The law will likely be named Caleb's Law, after the Holiday Inn worker who life was severely impacted by the harassing filming of an emotional breakdown while at work in April 2021"

They can try to regulate uploading the videos to US based hosts like youtube. But they can't make it a crime to film someone in public.


As of right now you have no expectation of privacy in the public view. You can legally be recorded and uploaded.

It will be up to the person video recording to not film if anyone else is in the background. This is particularly a problem now due to facial recognition.

Apparently over the last few years, psychologists worldwide have reported massive number of patients who are limiting going out into public places due to the fear of being filmed. In fact supposedly there is a new term being listed in the DSM6 referring to this as now being one of the leading causes of social phobia, as well as anxiety and depression caused by peoples unwanted recordings being uploaded online. The laws are being proposed due to similar psychological consequences that revenge p ron cause.
