Motorcycle Accident

Can I get some input? I got into an accident a few days ago where I was ejected 10 feet (per the paramedic). I was approaching a T-intersection and this car pulled out making a left hand turn and I braked and swerved right and ended up hitting its rear driver's side.

Right hip fracture requiring 1 month off work, no surgery. Cop at the ER says he's gonna site me for speeding because witnesses said I "looked like I was going fast" and I'm like that doesn't even mean anything. I believe I was going the limit because prior to the intersection I hit a curve so I left off the throttle, hit the breaks, and was slowly rolling back on up to speed prior to the intersection. Speed limit of 50mph and I belive I was going 45-50 at the time.

So I then asked is she getting a ticket for blowing the stop and interfering with my right of way and he was like "Nah they said you were speeding so I gotta give you a ticket dude. Sorry. If they didn't say that I wouldn't." He said the greater obligation was on me for speeding (allegedly) and not on her for not making sure it was safe to cross prior to making her left hand turn.

I'm taking it to court but does anyone know how fast you would need to go to be ejected 10 feet? Is being ejected 10 feet a lot for motorcycle crashes? I really don't believe I was speeding and think this whole thing is BS. I had the right of way.

my friend was hit on his motorcycle in a similar fashion and got like an 80k payout (ded fkn Srs)

but you hit the rear so they'll jsut pull out the ole well you shouldnt have been following so close.

What were the extent of his injuries? I dont belive mine would amount to much. I'd like to get a copy of the accident report to see if the cops can determine what my speed was at the time of the collision.

Luckily I should heal fully in about a month. Not really banged up. Just sucks because I can't move around too good right now.

iirc some nerve damage in his hand/wrist area and he broke something but i cant remember exactly what it was

bro thats awful. sorry you had to experience some **** head while on a bike - other people are always the biggest risk while riding

I didn't get a look at either. I was in a c-collar and transported to ER immediately. I assume the bike is trashed. No interest in fixing it.

Get a lawyer.

I know a guy who the exact same thing happened and he was launched pretty far, but was ok, but he gave up bikes. Is that you also done with it? He went nuts though and lost it and punched through the drivers window.

I think I'll probably ride again next summer. Need to chill for a bit I think and let this pass. If I felt I was being reckless or stupid about it or at fault then I would reconsider it and feel like motorcycles aren't for me. But I really feel like I didn't do anything wrong. I definitely could have been more precautious but I wasn't being stupid about it.

Yeah I saw that earlier myself but I don't have a lot of the variables. I dont know how they figure that shiet out. I think they need to know angle and hang time and other stuff. I tried figuring it out myself but don't really know how.

That's the truth. I've only been riding about 2-3 years and the main reason I started riding was to get girls attention. But now I mainly like it because I find it fun. It feels great. But any random person not paying attention can fukc your shiet up an a second. You'll never be the same. Even worse with a passenger. You'll have a hard time living with yourself if anything happened to them.

That sounds horrible Op. Eerily similar to a lady I work with that had a motorcyclist plow into her rear quarter panel as she turned left onto a T intersection. They estimated he was doing 70 in a 35 and that there was no way she would have seen him coming around a bend about 100ft or so away. The rider slammed into her and was ejected 10 or 12 feet into the air. He was life flighted from the scene but died a couple days later in hospital. I hope things work out for you.

I'm actually looking to get my first bike very soon...just took the MSF course this last weekend

It's for this very reason I don't plan to take any passengers at all, or in the very rare occasion that I do, it will only be very inactive side streets in my neighborhood.

Misc accident lawyer here. I’m not licensed in your state and ypu probably have different laws/statutes, etc. But if it were here, these would be my thoughts:

The ticket is garbage but if the statute says something like “failure to control speed to avoid a collision” a judge probably wouldn’t throw it out in my state. (Basically they’ll just take the cop’s word).

But also, in my state, the citation is not determinative of whose fault it was in a civil action for personal injury/property damage. If that were here in my state, I’d say you have a solid case for damages.

No way in fuk a citation will hold up because witnesses said “looked like he was going to fast”. It shouldn't have even been written. Im pro leo but that officer is a fn retard.
Get a lawyer. It rly doesnt sound like you have any fault. A month is a long time to heal up so your pretty fukked up and the driver should be held accountable. Now if you where hauling balls then different story but if youve got some miles on you you know when your speeding and when your not.
