Make them fire you over a vax mandate, do not resign or quit.

They know they're on shaky ground legally. Force them to do the proper paperwork to fire you through HR. If you quit or resign (their preference), you may lose your ability to file wrongful termination suits. They know this. They want you to leave on your own. Don't let them off the hook. If you are in this position, retain a lawyer knowledgeable in this area of the law.

There is also the issue about the constitutionality of the federal government mandating the vaccine, which could lead to subsequent firings. Also state laws vary. Ultimately, if you voluntarily resign, you lose most/all leverage you may have for later legal action.

Regardless of judges throwing out lawsuits in the above links, it is pretty suspect that this nurses boss and HR do not want to file termination letters and follow the proper steps.

You'll need a lawyer to answer that. This is all unsettled at this point. The Biden clown show currently in power is trying to force this on us by claiming it's well within existing regulations, but those regulations haven't necessarily been tested in court. In the video, they were clearly avoiding directly firing her over her refusal to be vaccinated. I think the implication is that their lawyers are concerned about lawsuits.

Don't most companies hire you as "at will" employment? I can't remember getting a job where it didn't say that they could terminate your employment at any time and for no specific reason. Couldn't they just do that to avoid any potential legal issue?

What OP means to say is, please don’t read this court opinion that cites a Supreme Court case, federal statute and a typical state law statute that goes against his entire argument.

I don't think they can fire you over confidential medical issues. You shouldn't have to disclose ANY medical facts to your employer. In fact, HIPPA makes it illegal for those facts to be disclosed to employers.

There is no instrument or mechanism that can provide for the power necessary for the president to mandate an injection.

Companies will simply comply in the mean time until the legal system sorts it out. They don't know what to do. If you get "fired" during this period then its obviously over the vaccine, not incompetence.

Yes, but they still have to do the paperwork and that allows you to get unemployment benefits. Quitting does not. The point is to NOT unwittingly weaken your own hand when it comes to pursuing litigation later. HR departments exist for a reason. If your employer isn't having you go through normal procedures, there is a reason for it. I promise you they are trying to cover their own ass because they don't know what liability they may have. However, if they can coerce you into handing in your badge and walking out the door without going through HR and having final exit interview and all of that usual stuff, then you've given them all they need to claim that you willingly quit by walking out of or not showing up for work, and it was unrelated to the vaccines.

We are aware of President Biden’s Executive Order last week directing the Occupational Safety and Health Administration (OSHA) to implement Emergency Temporary Standards that will require U.S. private-sector employers with 100 or more employees to ensure staff working in offices are fully vaccinated or be tested weekly. Like many other companies, we are awaiting further guidance from OSHA and will share any updates when we have clarity on the requirements. At this time there is no change to our vaccine requirements, though we do encourage team members to receive the vaccine, as indicated above.

Depends on the state.

Georgia is an "at will" state and firing someone here without a specific reason or justified is a nightmare....you cant just cite "Lack of Performance" without having lengthy documentation to back up the claim. My last job in management here we had to have 3 increasing in severity, documented disciplines on the employee with witnesses, then a "performance plan" to get them back on track, then when they didn't meet the objectives outlined in the plan we could fire them and even then the company was hit with multiple "unjustified termination" lawsuits. (No racist) but all of them were citing that the employee was fired because they were Black....not even kidding....even though 80% of the workforce was, including other management.

agree with OP, make them fire you. You give up all your future leverage if you quit.

I think the Dems will protect employers right now, but who knows where this is going to go a year, two years, five years from now.
