Jeez OP i dont see why this is a good thing. How does a homeowner know that this person is going to endanger them, their children, or significant other? Obviously we should be able to talk to the perp to ascertain intent prior to dispatching with extreme prejudice.

Depends on the state, and grave danger is up to the interpreter.

For instance this is Idaho Stand your Ground Law

19-202A. DEFENSE OF SELF, OTHERS AND CERTAIN PLACES. (1) No person in this state shall be placed in legal jeopardy of any kind whatsoever for protecting himself or his family by reasonable means necessary, or when coming to the aid of another whom he reasonably believes to be in imminent danger of or the victim of aggravated assault, robbery, rape, murder or other heinous crime.
(2)The defense of self or of another does not require a person to wait until he or she ascertains whether the danger is apparent or real. A person confronted with such danger has a clear right to act upon appearances such as would influence the action of a reasonable person.
(3) In the exercise of the right of self-defense or defense of another, a person need not retreat from any place that person has a right to be. A person may stand his ground and defend himself or another person by the use of all force and means which would appear to be necessary to a reasonable person in a similar situation and with similar knowledge without the benefit of hindsight. The provisions of this subsection shall not apply to a person incarcerated in jail or prison facilities when interacting with jail or prison staff who are acting in their official capacities.
(4) In any prosecution for the unlawful use of force, including deadly force, or the attempted or threatened use of force contrary to title 18, Idaho Code, the burden is on the prosecution to prove beyond a reasonable doubt that the use of force, attempted use of force or threat to use force was not justifiable.
(5) A person using force or deadly force in defense of a habitation, place of business or employment or occupied vehicle as defined in section 18-4009(3), Idaho Code, is presumed to have acted reasonably and had a reasonable fear of imminent peril of death or serious bodily injury if the force is used against a person whose entry or attempted entry therein is unlawful and is made or attempted by use of force, or in a violent and tumultuous manner, or surreptitiously or by stealth, or for the purpose of committing a felony.

"It's called 'defense of property' in New Jersey," attorney Tim Farrow said of the "castle doctrine," a principle in many states and countries that allows a person to use force without trying to flee first, if someone unlawfully enters that person's home. Even though New Jersey has the Castle Doctrine, which means you do not have to retreat when inside your own home, there are certain rules that apply.

You cannot be the initial aggressor that caused the situation to take place. If you’re the initial aggressor, then a duty to retreat exists. Also, if you can retreat with complete safety, then again, you have the duty imposed because you could escape with complete safety.

LOL at anybody breaking into my house with 2 Pitbulls and a 45. Talk about suicide mission.

I hope to never shoot anyone though. I wouldn't describe it as 'GOAT' to shoot someone. It's nice to know the law is on your side.

Too many home invasions have ended with the occupants being murdered, often in a horrific manner. There should not be any quarter given.

If you chose to invade someone's private property, a place which should be a safe haven for them, then all bets are off.

There is a legal presumption that if someone breaks into an occupied home, that they are there to do harm, and therefore deadly force may be used against them. That means you can shoot someone in the back, etc. and that you have no duty to retreat.

In college, one of my teachers was a captain of the local sheriff's office and gave us the scenario of- "You are at home at night and see a figure walk by a window. You arm yourself and go outside to find a stranger who has opened the window to your 5 year old's room and they are halfway in. What do you do?" The person isn't technically all the way in, right? Well he didn't seem to mind and said the home owner would be fully justified in shooting the person in the back as they were hanging halfway in the window.

Thankfully FL also extends the Castle Doctrine to your vehicle, so if someone is attempting to gain entry and car jack you, you can shoot them.

They are grown ups. They understood that they were in someone elses house stealing what he worked hard for. Extreme prejudice has to be in place or people will think they can get away with this kinda ****. Unless you set a standard and make people fearful of breaking the law, they will continue to break the law. You can't walk backwards on these issues you have to move forwards. Grow up dude... very serious.

To add to that, you shoot to kill, you DO NOT shoot to wound as that will be held against you. You shoot to wound that spells they were not a threat to your life.
