You fire right when the glass breaks then you can argue he was attacking but once he started walking away its kind of difficult.

Always keep in mind if you have to use deadly force against someone, it need to be to stop an attack, not to "kill" even though their death is a side effect. What's more even if you are justified and you are in a castle state/stand your ground state, if you shoot someone it's not going to be over that night/day, or even a week or month. It's probably going to cost you a lot of time and money, and there is a chance it can go badly for you and you go to prison. So unless there was no other option, I won't pull the trigger.

So he got it on cam and hopefully got his tag. Most likely the cops are going to arrest him and treat him like a violent criminal. He's going to get cuffed and jerked into a squad car and hauled to jail. Most likely he will do other stupid things in the mean time. He's going to have to pay for the window, install, rent-a-car, and probably more, plus catch a criminal charge. Then he won't be able to pass back ground checks for employment and next thing you know that BMW will be on the back of a repo-truck.

The root of the problem with the right to defend oneself being increasingly stripped away from the people is that the higher-ups are the ones who want the options and the rights, and they want to be able to fine and put in jail anybody who they want, and if you are "caught" or "found guilty" of the unconscionable act of defending yourself, well, that's just more job security for judges, litigators, probation/parole officers, cops, etc. It's called slavery.

Depends where you live. Maryland has a duty to retreat law, so if you shot him for breaking your widow you’re going to jail for murder.
There is no they…
