Delaware lowers passing score on bar exam in push for racial diversity

The Delaware Supreme Court lowered the passing score on the state's bar exam amid other changes reportedly intended to increase racial diversity among the state's lawyers.

The 200-question multiple-choice exam will be offered twice instead of once a year beginning in 2024 – and its passing score will be lowered from 145 to 143, according to local outlet WHYY.

The number of essays on the exam will be decreased from eight to four, and the number of essay topics will be reduced from 14 to 10.

The clerkship requirement is also being lowered from 21 weeks to 12 weeks, and the mandatory list of 25 legal proceedings that potential lawyers must attend has been shortened to 18 out of 30 possible items.

In the court's announcement of the changes, Chief Justice Collins J. Seitz Jr. pushed back against any assertion that they reflect a "lowering of standards" and referred to them as a "modernization" of the admission process aimed at aligning with the standards in other states.

Seitz, who began the diversity project that led to a report that suggested changes to the exam, maintained that such revisions will enhance competitiveness in attracting legal talent to the state that serves as a hub of business litigation, according to Reuters.

Just means that having passed the bar means less than it already does. Isnt' the legal field already oversaturated? All the result will be is even more people practicing law that have no business representing anyone.

Blacks can't compete academically so they lower the standards to get more in. It's happening everywhere right now. It's why with affirmative action in admissions about to be crushed by the Supreme Court, colleges are now preempting the move by lowering their grading standards, removing the SAT requirements, etc.

It sounds like they were overdosing on white savior complex to come to that conclusion.

You'd think that for such "open minded" andthoughtfulpeople, they'd consider all possible factors explaining any ethnic disparity in a given field, but specifically forlaw?The whole idea is that the law should be equitable and justice blind to such things, and a legal representative should be qualified regardless of the color of their skin. Bringing population figures into the equation should be utterly moot; a black lawyer is not going to only represent black clients, and any lawyer who would treat their clients differently based on race has no business practicing law in the first place.

How would it increase racial diversity? The scoring gap is normally so large it'd just mean a larger slice of the top performers will be chosen. And there's not much diversity in that slice. Whoever designed this policy is virtue signaling in an awful way.
