Misc lawyers... (advice) Town demands i remove my palm trees...

So i got a letter with a court date IF i don't remove trees. I emailed the guy (nicely) asking to be more specific.

Reply was kinda nice but he says this...

6 to 9 feet from the street (see below)

I measured and they are as follows

Poverty trees/yard

Obviously i think i have a case to tell him to go fuk himself...

You in Florida? I'm in NSB and I think we have kind of the same deal, where even though we don't have sidewalks in our neighborhood the city technically owns enough room to create one and we can't build/plant there because of it. Example of property lines:

I think you might actually need to replant if the city is taking issue with it

The public right-of-way does not extend approximately anywhere. Its an exact distance measured from the centerline of the road. Find out what their right of way is exactly and you can probably demonstrate that you are out of it.

If you are not out of it, then they are not your palm trees and tell them its on their property take them down yourself.

you don't need a lawyer. either they are in the right-of-way and they will take them down and there is nothing you can do about it, or they are on your property and they can fuk off.

What most likely happened is some new code enforcer or some miserable prick was riding around killing time until his government alloted 3 hour lunch break and saw that you had planted in front of those blue flowering bushes. He probably assumed that was the "right of way" border and instead of measuring he wrote you up, because thats easier and doesnt require first grade math and or bending down three times. Then his pencil pushing buddy in a cubicle wrote you that letter. The two of them together may have enough IQ points to hit triple digits, but one on one they are legally retarded, which is why they work for code enforcement. Id reccomend you dont deal with either of them and go to the building and speak with the highest ranking bureaucrat you can find before they put you on a waiting list to make an appointment. They will 100% think they are right without inspecting the situation, so be prepared to repeat yourself 4-5 times and have at least 3 videos proving your case and dont forget another three forms of ID. This will be the biggest headache of your year and honestlly, it may be better to just go to court where at least the judge will not be a failure in life.

Reguardless of what happens, you are now on the "list" so keep those trash cans tidy and that grass no higher than 2.75 inches boyo, otherwise they will be back.
