I was just listening to Michael Smerconish earlier discussing this case. He was saying it was interesting SCOTUS took so long to decide whether to hear the immunity arguments. If they kicked it back to the lower courts, Trump would certainly be tried before November. Now that they’re taking it up, even if they rule against him (likely) no chance Chutkin gets to set a trial date by the election.

My guess they say the appeal court made an incorrect decision before fact-finding was complete (if Trump was or wasn't in scope of office) it gets sent all the way back to DC court for fact finding in that - goes through appeals again then back to scotus again before a trial

In my opinion, the case is fairly simple. Does the president have immunity in certain circumstances? The obvious answer is yes, in the same way that soldiers do. As the commander in chief, POTUS must have at least the same level of immunity as military members acting under orders.

There should be no argument about whether POTUShasimmunity, there should only be an argument aboutwhenthey have immunity.

Nobody wants to have that argument, as if you define exactly when a president does and does not have immunity, you may find that past presidents have committed many acts that fall outside of that immunity.

Even though people don't want to have that argument, it's one that needs to be had. The only problem, for both sides, is that it may result in a ruling that states Bush, Obama and others committed criminal acts that were not covered by immunity.

On a side note, I believe that was the intention of impeachment. That blanket immunity exists, but if their behaviour stepped outside of what the vast majority found to be acceptable, impeachment would follow and then criminal charges if successfully impeached. Impeachment would strip them of immunity for the crimes that they were impeached for.

That is howI, at least, would have designed it to work.
