New York’s First Judicial Department appellate court
The New York’s First Judicial Department Appellate Court is one of the four intermediate appellate courts in the State of New York. It has jurisdiction over the counties of New York and the Bronx. The court hears appeals from the Supreme Court, Surrogate’s Court, Family Court, and Court of Claims, as a matter of right, in both civil and criminal cases.

Jurisdiction

The First Department of the Appellate Division holds jurisdiction over the Counties of New York and the Bronx. Appeals are taken to the Appellate Division, as a matter of right, in civil and criminal cases, from the Supreme Court, Surrogate’s Court, Family Court, and Court of Claims.

Structure

The court is composed of justices who are appointed by the Governor from among the justices of the New York Supreme Court. As established by executive order in 2011, the Governor must appoint justices to the appellate division from a list of recommendations supplied by a judicial screening committee. Appellate division justices serve five-year terms, or until the end of their supreme court term, whichever comes first.
