Some states have what is called Alienation of Affection laws which do allow for criminal conversion both against the spouse and the other party who cheated.

Personally I am not for it unless the cheating gave the unsuspecting party a permanent STD. i.e. if I got herpes because you were cheating with someone who had herpes, its at least a civil suit and possibly a criminal one.
