Same with rape in these situations. It's not your fault that someone decided to try and rape you, but being blackout drunk didn't help you stay safe. Hookup culture needs to die ASAP since too many bitches think they can get WGW around a bunch of horny fuking dudes and expect everyone to take care of her and keep her safe, despite the fact that there are a lot of weird, sick fuks on the planet who would take advantage of them if they get a chance.
Worst of all, bringing these points to light gets you shunned and vilified because apparently people cannot suggest someone to defend themselves without it being in the context of 'it's your fault'.

People love jumping to conclusions. I guess simple minded people like simple answers.

In the end, none of us were there other than those two idiots and something beyond chitty happened.
- Maybe she was talking to him the entire time, coming onto him, they went to get laid and things just got sloppy behind the dumpster?
- Maybe she wanted nothing to do with him but the guy is a predator who took advantage of the situation to do whatever sick and twisted things came to his mind and deserves his angus penetrated in jail?
- Maybe somewhere in between?
Sad reality of the world we live in...

The most powerful incentive to not demonize drunk people for their actions:
NOBODY HAS TO GET DRUNK.
If you are afraid of the world, afraid of getting fuked, or touched, or intimate, NOBODY IS FORCING YOU TO GO THERE.
So thats where people cross the line of freedom, because they are free to not get drunk. But people who get drunk cant feel safe without catching a case.
When people are drunk thats it, nothing counts. They have left their humanity behind.
So again, nobody has to get drunk, there is your safe zone, now let drunk people have their safe zone too.
Its the fair and humane way to treat people, not to want to ruin their lives.
Every law has its minimums and maximums. Save the maximum sentence when it was like a real life rapist out there kidnapping real girls and raping them.
Not some drunk children trying to figure the world out still, still trying to figure out what being drunk is even like. Getting used to the poison. Making their first mistakes. Growing up.

Lol you're a *******.
Got blacked out last Saturday night. Had a great time. Wasn't raped by some ugly beta swimmer loser. Rapists are phucking pathetic and the people that defend them are a joke. And you probably just can't get any hole so you're a rapist sympathizer and bitter at women.
Edit: I thought she was raped while unconscious behind a dumpster. If she was just fingered while conscious, why the flying phuck is this in the news.

Are you telling me that you would be emotionally scarred IF (don't change the context, *******s, I said IF):
1. you got drunk
2. you met a girl who was also drunk
3. you and the girl found each other attractive.
4. you danced and kissed
5. you gave her consent to give you an old fashioned wristy
6. sex naturally progressed
7. you passed out but she just kept going, or thrusting, or whatever the faurk the article says
Would you seriously cry every day--for a year mind you--, to the point where you needed to put cold spoons on your eyes because they are sore from crying (word for word from the video)?
(let me remind you that she supposedly wasn't conscience while it happened, so she doesn't remember. I only say supposedly because it is disputed on either side of the story)
I wouldn't. I would maybe just be ashamed to have let a whale ride my cawk, worst case scenario. But that doesn't even seem to be the case. If it was somebody I actually found attractive, it doesn't even matter if I had only met her that day, I would not feel stripped of dignity or violated or anything the next morning just because some chick kept riding my cawk after I passed out.
I don't want to believe that swimmer bro found an unconscious chick, threw her out behind a dumpster, and proceeded to pound way. If he did, then I absolutely do not dispute hes a rapist. But I'm thinking it didn't actually go down like that

I get that a lot of guys are upset at the fact that there's too many stories of girls having sex with guys and then calling rape due to their regret. But Ho Lee Fuk at anyone who even slightly defends this guy. Doesn't matter if its a girl or guy that passed out, when someones unconscious one of the scummiest things someone can do is take advantage of them. Whether or not he had sex with her doesn't even matter, the fact that he was making out with her and finger banging her when she is passed out is f*cked up. I don't even understand how people can be so f*cked to even consider doing something like that. Whenever we go out and see that someone is passed out, we make sure they make it home okay. Either by having one of their friends take them home or getting them some medical help.

Something like this is more accurate:
-Got drunk and lost control of his logical choice making as a human being - punishment 6 months in jail
As opposed to:
-Raped a girl - 10 years in prison
All Im saying lets be fair and punish justly and call a spade a spade. That is the honorable Judges job to interpret the laws. The less malicious the intent the more mercy we should have and we should care about wanting our citizens to become successful adults and members of society. All human being make mistakes especially when still growing up.
People are still gonna try to not commit crimes while drunk, but if AND WHEN it happens, we should be sound in our judgement of what our fellow citizens deserve.
Ruining peoples lives is not the point of our laws, in fact they are in place for the opposite reason.
A drunk person cant be afraid of, or be fairly held accountable for, a law they cant even properly comprehend while drunk.
Yet alcohol is not illegal.

Saying to a person 'don't get blackout drunk' is solid advice for any occasion. It isn't victim blaming, and isn't close to being on par with 'teach men don't rape'.

Srs question. I think intent would play a big role in that and the circumstances of how you got to that point.

But surely, when theres drinking, it blurs the lines.

a.) chalked this up to two sloppy drunk kids (as oppose to the rapist having intent/malice)
b.) sees the defendant as a 0% chance re-offender
c.) sees a high % for rehabilitation
Maybe I'm missing something

I do think that this isn't as serious a case as a serial rapist breaking in to people's homes with a weapon, but 6 months is to minimal for any rape imo.

We now know all of this is wrong, thanks in part to the work of D.M. Lovinger, PhD. In 1989, while at Vanderbilt University, Lovinger reported that consumption of alcohol sometimes blocks NMDA receptors transmitting glutamate to the hippocampus in the brain.1 In simple language, alcohol sometimes blocks short-term or working memory from forming in the brain. Some time elapsed before Lovinger's work was applied to blackouts, but we now know that those experiencing a blackout did not forget what happened-they never formed any memory. They will never remember, even when told of it.
Still more time passed before the significance of loss of memory formation was realized. Blacked-out persons are functioning on long-term episodic, semantic and procedural memory. They remember everything up to the moment of blacking out. They can carry on a conversation, drive a car, have sex, get into a fight. They may appear normal to those around them.
But they have lost their short-term memory by which immediate or sensory memory is amalgamated into working memory. Their immediate memory of what they just saw, heard or felt lasts perhaps a few seconds if they are not distracted by something else they saw, heard or felt. They are all past, very little present and no future.
For the hours, sometimes days such persons are in a blackout, they have lost their consciousness of self, their awareness of who and where they are. They are lost in the truest sense of the word-lost to themselves, lost in space, lost in time. They cannot think, learn, plan or form intent. They are unaware of what they are doing, let alone why. They have lost what Nobel Prize Winner Gerald M. Edelman calls higher-order consciousness2 and with it much that makes them human beings. They are in a precarious position, acting on impulse without conscience or inhibition.

Is it totally unreasonable that she passed out just moments prior to being discovered with turner?
Evidence.
Californians have a right to bear arms in public!

Source on the 10 minute conversation? I can only recall her trying to call her sister, and leaving an incoherent voicemail message for her bf.
