Yes I agree the consent part is bullchit. I presume it was originally put in place to protect drunk people against sober people, however it's now being used when both people are drunk which is ridiculous. They should probably just make it so you can consent in any state as long as you're not unconscious.

In the end, none of us were there other than those two idiots and something beyond chitty happened.

- Maybe she was talking to him the entire time, coming onto him, they went to get laid and things just got sloppy behind the dumpster?
- Maybe she wanted nothing to do with him but the guy is a predator who took advantage of the situation to do whatever sick and twisted things came to his mind and deserves his angus penetrated in jail?

The most powerful incentive to not demonize drunk people for their actions:

NOBODY HAS TO GET DRUNK.

If you are afraid of the world, afraid of getting fuked, or touched, or intimate, NOBODY IS FORCING YOU TO GO THERE.

So thats where people cross the line of freedom, because they are free to not get drunk. But people who get drunk cant feel safe without catching a case.

When people are drunk thats it, nothing counts. They have left their humanity behind.

So again, nobody has to get drunk, there is your safe zone, now let drunk people have their safe zone too.

Its the fair and humane way to treat people, not to want to ruin their lives.

Every law has its minimums and maximums. Save the maximum sentence when it was like a real life rapist out there kidnapping real girls and raping them.

Obviously in this case the girl was also drunk, but to argue that you shouldn't be held responsible for a crime you commited while drunk because its not "really you" means that drunk people would get away with bad decisions that affect those choosing not to drink to. As you said, no one is forced to drink, so if you make that choice knowing you're the kind of person who can't stop yourself from commiting a crime while drunk then that's your choice.

I get that a lot of guys are upset at the fact that there's too many stories of girls having sex with guys and then calling rape due to their regret. But Ho Lee Fuk at anyone who even slightly defends this guy. Doesn't matter if its a girl or guy that passed out, when someones unconscious one of the scummiest things someone can do is take advantage of them. Whether or not he had sex with her doesn't even matter, the fact that he was making out with her and finger banging her when she is passed out is f*cked up. I don't even understand how people can be so f*cked to even consider doing something like that. Whenever we go out and see that someone is passed out, we make sure they make it home okay. I'm a girl. I'd be devastated, however I also don't put myself in that situation. to be fair I don't think I'd cry for a year though. And it probably would be more scarring if she wasn't interested in him at all (and like you said, your scenario is an if).

Well all Im saying is they should get proper and appropriate sentencing as a punishment.


Something like this is more accurate:

-Got drunk and lost control of his logical choice making as a human being - punishment 6 months in jail

As opposed to:

-Raped a girl - 10 years in prison



All Im saying lets be fair and punish justly and call a spade a spade. That is the honorable Judges job to interpret the laws. The less malicious the intent the more mercy we should have and we should care about wanting our citizens to become successful adults and members of society. All human being make mistakes especially when still growing up.

People are still gonna try to not commit crimes while drunk, but if AND WHEN it happens, we should be sound in our judgement of what our fellow citizens deserve.

Ruining peoples lives is not the point of our laws, in fact they are in place for the opposite reason.

A drunk person cant be afraid of, or be fairly held accountable for, a law they cant even properly comprehend while drunk.

Yet alcohol is not illegal.

Do people that get into car wrecks under the influence of alcohol and who kill the person they collide with get sentenced for murder, or manslaughter? Srs question. I think intent would play a big role in that and the circumstances of how you got to that point.

Fair point. Obviously I would be pissed if they were only getting 6 months to though. In that case the difference is whether they were intending to kill someone or not. You can kill someone without meaning to, you can't rape someone without meaning to (even if it's not something you would've done sober it was still an intentional act rather than something unintentional but still caused by you).

Thats up to the judge to decide on a case by case basis and of course the level of intent.

But surely, when theres drinking, it blurs the lines.

I think the details of the case promoted the 6 month sentence. I don't have a solid grasp on the case yet -- but it appears to me that the judge

a.) chalked this up to two sloppy drunk kids (as oppose to the rapist having intent/malice)
b.) sees the defendant as a 0% chance re-offender
c.) sees a high % for rehabilitation

I think the details of the case promoted the 6 month sentence. I don't have a solid grasp on the case yet -- but it appears to me that the judge

a.) chalked this up to two sloppy drunk kids (as oppose to the rapist having intent/malice)
b.) sees the defendant as a 0% chance re-offender
c.) sees a high % for rehabilitation

She was dry humped and fingered while unconscious. She was violated and injured. I think if it was just dry humping this wouldn't really be going anywhere even though it's still creepy. It does lead me to wonder what he would've done if not caught, but of course you can't charge people for something they might’ve done.

I do think that this isn't as serious a case as a serial rapist breaking in to people's homes with a weapon, but 6 months is to minimal for any rape imo.

Their immediate memory of what they just saw, heard or felt lasts perhaps a few seconds if they are not distracted by something else they saw, heard or felt. They are all past, very little present and no future.

For the hours, sometimes days such persons are in a blackout, they have lost their consciousness of self, their awareness of who and where they are. They are lost in the truest sense of the word-lost to themselves, lost in space, lost in time. They cannot think, learn, plan or form intent. They are unaware of what they are doing, let alone why. They have lost what Nobel Prize Winner Gerald M. Edelman calls higher-order consciousness2 and with it much that makes them human beings. They are in a precarious position, acting on impulse without conscience or inhibition.

I don't think I did know that, but if she did happen to fall unconscious right then he should've used that as his defence instead of claiming her to be concious and talkingb the whole time including when he got off her when the swedes arrived. A dodgy story doesn't help his case and he has more to gain by lying than the witnesses.

Source on the 10 minute conversation? I can only recall her trying to call her sister, and leaving an incoherent voicemail message for her bf.
