I truly think it's because we're so in love with our phones and our cars that we can empathize. We can imagine making the same "mistake"... maybe one time. Whereas when people hear about some accidental shooting or worse an intentional one they immediately freak out like "ban the gun no one needs those!".

I would argue we don't NEED cars and we sure as hell don't need to be talking on a phone or using a computer while driving a car. No one wants to look @ the raw #'s or is even slightly outraged... in fact they are extremely tolerant. All because we are, as a society, in love with this technology.

INB4 "I need a car for ____".

This guy was unlucky that his choice to commit a dangerous crime actually had the expected consequences, the ones that make what he did a crime in the first place. All of his bad luck flowed as a consequence of his criminal intent.

Yes, many more will get away with acting on their criminal intent because they have an extra stroke of luck. That doesn't minimise what he did - what he chose to do.

He is making a decision with a clear head rather than while he is blinded by anger and sadness. The judgment of people in their most irrational state of mind should not be seriously considered. Why are you aiming to have legal issues framed in the most emotional way possible? Why do you think so much effort goes in to picking a fair jury (least biased)? Angry families calling for the maximum punishment because they were wronged ought to be mostly ignored in any legitimate legal system. The ultimate question is, "What is the most reasonable and sensible legal action that can be taken against him?" not "How would I want to punish him if it happened to me?"

Really annoys me that the police & media always use the term accident when actual road accidents are very rare. The overwhelming majority of cases are excess speeds, not driving to the weather/road conditions, driving while under the influence of drink, drugs or prescription medication that they know makes them drowsy, driving without enough sleep, pissing around with phones, make-up, music systems etc, not wearing seat belts, driving on the wrong side of the roaf/goingthe wrong way on the motorway, not maintaining your vehicle properly-driving on bald tires etc. The actual incidences of a genuine accident such as an animal running on the road with no time to react, somebody having a fit at the wheel etc are pretty low.

Accident, at least as other people use the word, does not mean there was no neglect, or that the bad event was pure bad luck. These things are all widely defined as accidents, and many/most accidents are widely accepted as reasonably preventable - it's not a misnomer.

You can't hold him to the same standard as the general public for two reasons:

2. He was WORKING. This is the man's job. This means that he is on the road more often and for longer periods of time than other drivers and consequently driving infractions pose a more frequent and greater risk when he perpetrates them (both because of his time spent on the road and the size of his vehicle). This would be like a chef that willingly disregards cleaning a cutting board he just used to prep raw chicken and which he is now using to prep raw vegetables to be served as is to a customer. When you are performing a job that contains potential, catastrophic consequences for other persons you MUST abide not only that job's protocols but also any laws governing conduct within that occupation aimed at saving lives and reducing risks.

The man had a JOB to do and he didn't do it right and it cost four people their lives. Unacceptable.
The closer we approach the uncertainty of life's ending the more we wish to trade all of the things we have acquired in exchange for all of the things we have lost: wealth for youth, knowledge for fresh curiosity, resignation for hope. We'd trade our wisdom for new experiences, but it is wisdom that will teach us that at the end of the road the only new experience is death.

Also, thinking that there is no difference between what this guy did and what James Holmes did, is as big an error (and a similar error) as thinking that there is no difference between what this guy did and what a guy whose no-fault accident killed people did.

There is a difference between an innocent accident, criminal negligence, and premeditated murder. They all lie on different maps of intent, they all have different legal consequences, and they all have different risks for future behaviour.

Why would you think, "But what if it was your family member!" would come into the evaluation of punishment. It's a justice system, not a vengeance system.

It's literally a non-point. I don't give a fuk whose family member it was, that is not a consideration when establishing punishments.

There are places that have a similar rule for killings that occur during Burglary. An unarmed burglar doesn't intend for anyone's death but if his accomplice is killed while they are breaking and entering he can be charged with murder.
