it already didn't go in that direction. Action was needed. taking the dog to the vet. And no, property rights and liabilities wouldn't come into place if the dog had been healthy, trespassing, and attacking. he would have been perfectly justified.

The reporters description of the condition of the dog when it was discovered does not read like the dog was in a survivable condition. I've had dogs hit by cars that did not survive, they crawl back to home or some dark place to lie down and expire in excruciating pain.Anecdotal evidenceThe sledgehammer sounds rough AND gruesome but without a firearm what other options would one consider at all to use with a pit bull or other large breed. Garcia, the dogs owner is the person who gave the description of the condition of the dog when he found him it is not Anecdotal Evidence it is his statement.
The guy was probably going for a rabbit punch. Most people freak out when having to kill something or think they know how to kill something. A striking death blow isn't as easy as it seems. 2 hits sounds bad but it also sounds like the guy didn't know what he was doing or where to hit the animal exactly on the skill. The killing of the dog didn't sound malicious from the actions he took, the guy got hemmed up on questioning and not calling the police later. It doesn't seem to read anywhere that he was being malicious. If he had had prior issues with that neighbor then it could have been but we don't have the level of detail in the article.
I didn't make a claim I quoted the dog's owner.
No one knows if the dog could have been saved by a vet, maybe an autopsy could tell but we don't have that information. I have seen dogs hit in traffic and the results.
