Not sure if srs. You can't force the driver to take a blood test, they have to consent.

If he doesn't comply with the CDL requirement, he loses his license. It doesn't mean the cops have the authority to make him take a test, nor can they force the hospital to provide a blood sample without a warrant.

How does exigent circumstance apply to the truck driver who was hit head on by another driver fleeing from the police? The police had no reasonable suspicion of the truck driver being under the influence.

Not only is that bad enough on it's own, but then try to put the nurse under arrest for what? Exigent circumstance is VERY shaky ground in this case to begin with, you have to reach pretty hard to claim she obstructed an investigation when they had no reasonable suspicion and no warrant.

The point is it should not have gotten to the point of the court having to decide.
