Doesn't matter. They weren't defending themselves on their property, or in their home, or whatever. They made a conscious choice to engage in the argument with the guy over some trash in a public area. If he made threats, you leave and call the cops. You don't get guns to try and win the argument. By getting them, it's assumed the intent was to use them.

Now bare with me because i'm playing devils advocate... I believe one can also reasonably assume the two men with guns had business in the alley (it is after-all a public place). And went to get guns to defend themselves from a baseball bat wielding psycho that was in said alley. Baseball bat could be considered a deadly weapon depending on who is using it and how they are using it. Its hard to determine how this will be presented in a court of law, but as of now with only the last half of the story being on video, its hard to be exactly sure what the outcome will be.

that beind said, I didn't see the guy who got shot weilding a baseball bat, just that it was said someone else got a baseball bat from his home. But you could be right, they may have been defending themselves. But the video evidence doesn't show any hint of that, and really heavily implies that they came ready for somebody to die. Multiple shots fired, stone faced expressions, DGAF about someone filming them the entire time, etc.

Reread the story and watch the video. It said someone else went to get a bat, and clearly in the video he has nothing in his hands. They killed an unarmed man. Pretty easy to determine how it will be presented.

They could have also came ready to only defend themselves, not necessarily for someone to die. They didn't seem to be chasing the man around with their guns. I'm just looking at the situation from the perspective as a defense attorney.

It gets really tricky here. How threatened were you? How serious were the threats? Who was making the threats? (a frail 90 year old woman or a 7 foot muscle bound cranked out on drugs gorilla? Did he have a weapon? A bat? These all play a part in the law of defending yourself from bodily injury or death. He may have initially not had a bat, but did he reach for one when the 2 gunman shot him? The camera was not on the victim when they decided to take the shots to eliminate the situation. This is all of course assuming the gunmen had lawful business to conduct in the alley.

They certainly didn't seem threatened. They didn't try to back away or anything, and kept testing the guy by "saying, come within 3 feet of me, I'll kill you" so they seemed to also be aggressors. I dunno, seems pretty clear cut to me. When the "unreleased" footage shows up in 3 weeks and there's a gang of homies wielding bats covered in chains and nails behind the camera girl, things might change.

lol. Warning someone to stay away from you because you don't want them to get close enough to cause bodily injury or death is not being the aggressor. Curious to see how this will be presented in a court of law. And curious of how the defense team will try to get these men off.

If you're pulling a gun on someone because you don't like the way they handle their trash, you deserve to be locked up. Unless it's on your property that you're responsible for, then who cares? While the guy was stupid to try to be alpha, thinking he can stand his ground and throw out threats when you got two guys with a gun on you, while you have no weapons or any sort of defense. He was asking to be killed.

Someone should have just been a bigger guy and walked away, but this what happens when stupid people settle disputes.

Not if they had business to conduct in the alley. Hear me out. This may be a bit of a stretch but just hear me out. This is what a defense attorney will argue.

If you go to throw out the trash and get in to an altercation with someone and fear for your life most normal people would leave the situation and just call the cops. But, if for some stupid reason you had to get the trash thrown out at that time and felt like you may have to defend your life doing so, going to get a gun for self defense and continuing with your trash throwing activities is within your rights. Not smart, but within your rights.
