This daily mail user sums it up pretty well...
Strongly disagree with all the commenters arguing that she knew full well what she was doing. She's a ten year old child - and likely a deeply disturbed one at that. I'm not arguing that she needs to be turned loose with no consequences, but premeditated murder? Her brain isn't even remotely developed enough for charges that serious (which in the US are death penalty charges). This is a horrific tragedy for an innocent baby, and I fully understand the father's rage. But blaming a disturbed child will not restore his precious baby boy to him. The emphasis now needs to be on actual justice - and that will be keeping this girl - and society - safe from her impulsive rage, likely via a lifetime in a psychiatric facility for the criminally insane. (No picnic, in case you think she's somehow "getting off easy").

Wow that's a horrible story. Clearly very shocking that it was a 10 year old child that did it. It would be easy to simply call her evil or a psychopath, but considering she was in foster care I suspect she's been abused at some point either by her parents or within the system. Doesn't absolve her of her actions but it does make her shocking behaviour more understandable in a twisted way, as she's likely a victim of something horrible too. She needs to be put away but also receive some kind of help too if she was indeed a victim of abuse.

Should ask that care center whether the girl has showed similar behavior before, because I highly doubt she consciously tried to kill that child. Being a (most likely) very troubled young girl, she might have panicked when the other kid started crying and then stomped on his head as a result. She's a 10 year old. Many of them are dumb, have underdeveloped social skills and they do dumb chit, sometimes even really dumb chit.

'She told investigators that she had picked Jaxon up but then panicked when she dropped him. The girl allegedly told police she stomped on his head when Jaxon started crying.'

You dont have a point. They know what death means. They aren't dogs or cats. A 10 year old is intelligent enough to understand what happens if you die. There's no coming back, period

Knowing what something is isn’t the same as completely understanding it, or realizing how your actions can lead to it.

Your kids understand flipping a light switch turns the light bulb off. Can they explain why? They probably understand how turning the key on the car makes it turn on. Do they understand what takes place to make that happen?

You’re kidding yourself if you think a typical 10 year old understands taking the life of a fellow human

Look on the inside story on the girl. Considering the violence she has endured her life, it's not surprising this outcome happened. She's a kid, that is why I defend her. An adult would be a different story.

Where the crime happens is that the caretaker, who was paid to take care of these children, and know of the issues, left her to watch the baby so should wouldn't have to. Imagine you have a child, and your friend is a zookeeper who says they will watch your child. They leave your child with the lions because they don't want to watch the kid anymore, lions eat your child, are you going to be mad at the lions? Of course, but who's to blame here?

Also the adults in that child's life who are responsible for her condition need to go to prison.

She’s fcking 10 she knows right from wrong. Imagine how fckn demented this child has to be to do something like this.

Little girls play with dolls and pretend to be a mommy by 5. The last thing this girl should’ve wanted to do was stomp a baby to death.

There’s no good outcome for this girl.

Imagine living with the fact you stomped a baby to death when you were 10

She's damaged beyond repair regardless of what happens to her. I guarantee you she's a psychopath. You don't stomp someone or something to death unless you enjoy it. On one hand if you put her in prison until she's 18 when she gets out she's going to be so fukked up and socially unaware she won't be able to exist on the outside and live a normal life-style. On the other-hand life in prison from 10 on up might be a bit excessive and considered cruel and unusual. If you don't incarcerate her you'd have to be sure she was kept isolated from other children basically until she's 18. Which is going to be hard to do.

Unfortunately I think the long term solution is going to be after she either kills a second person when she's a teen or young adult or does some other really fukked up crime that results in her getting put away for a long time. Some people are just ticking time bombs.

Going to sound fukked up but this comes to mind in his situation.

She's already a foster child so yeah she probably had mental problems from the start. I understand child-care is expensive, but letting someone babysit your kid when the have a foster child is absolutely crazy. A lot of those kids are really messed up and can't be trusted around other kids.

Awhile back I worked a case where a 9 year old girl was sexually abusing a little boy that was like 3 years old. Needless to say it was determined she was sexually abused growing up and once that person was incarcerated she flipped the switch on small children. Point being some kids can very well do some pretty evil stuff to other smaller kids.

I grew up hunting from 8 years old on. By the time I was 10 years old I'd killed dozens of animals. I understood very well what taking the life of an animal meant.

Also I can tell you from experience that a 10 year old kid that experiences the death of a close relative (Mother, Father, sibling, etc.) knows very well the ramifications of a death. At 7-8 years old that sort of thing is out of their comprehension usually.

This. If a 10 year old doesn't understand that, then they are developmentally challenged (and violently aberrant) and shouldn't be in society anyways. They are a danger to others and will remain that way. Not suggesting prison, but a home/mental hospital for MANY years.

Doesn't matter they understand basic principles. Hitting a light switch will turn it off. That's what they understand. Why or how it works is irrelevant.

Cause and affect is simple. Take a knife and stab a living thing it will bleed and die.

A clear link between serial killers is torturing small animals in their youth. No normal healthy functioning child stomps a helpless baby or animal. The girl may or may not be a functioning member of society. I doubt it.

You are wrong. How many 10 year olds do you interact with on a regular basis? Are you a teacher? Volunteer? Do you have children of that age?

The people who raised her are certainy responsible, but even if someone raises a pit bull to be violent and it bites somebody, we can punish the owners, but we don't let the pitbull roam free again after that.

I agree with locking her up tbh, and I'm normally a "give them the benefit of the doubt" kind of guy. At age 10, I knew it was wrong to just bully others. Let alone stomp on an infant's head. Most serial killers start off by hurting and killing animals.. Not humans. Not saying that's how she'd turn out, but she's showing some pretty bad signs.

I believe most people are a product of their raising, but in this case I think she is one of the ones born with bad wiring.

Put her down., No offense, to those saying shes just a girl, at no point in my life or my young kids that I know has ever wanted to stomp a child to death, age 1 or age 100. She is a demon and will never adapt normalize into society. She needs to be put down, otherwise we will spend money on her to become an more evil woman and get out and be a serial killer? You let her off the hook, and this will set a precedent for future kids court cases. This cannot be accepted and normalized under any condition. Srs

She should be charged with first degree murder and gets executed for what she did.

But we live in a cuck society so she will probably be released and kill some more babies
