I took the scenario from the article. Are you saying that the article is not true and that those laws do not exist? Why is there more than one article on this? Why is there an active outrage on this?

It will be a different kind of "swatted" where instead of calling in a made up story of person with a gun in their home threatening their family and then their house gets raided now you can call in a suspected drunk driver when you know theyve gone home to watch the hockey game with a 12 case. And now somebody who doesnt drink and drive is in trouble because somebody doesnt like them.

Its a dumb law change and is going to cost an innocent person legal fees.

Exception

(4) No person commits an offence under subsection (3) if

(a) they consumed the drug or the alcohol or both after ceasing to operate a motor vehicle or vessel, or after ceasing to operate or assist in the operation of an aircraft or railway equipment or after ceasing to have the care or control of a motor vehicle, a vessel, an aircraft or railway equipment; and

(b) after ceasing the activities described in paragraph (a), they had no reasonable expectation that they would be required to provide a sample of a bodily substance.
So you shouldn't be convicted over nothing, but you will still lose your license for 3 months, vehicle for 3 days, and have breathalizer ignition installed when charged, not when convicted.

Yes. I am saying that article and that scenario is 100% false. There is no way ever that a police officer will demand a breath sample from you in your house because of an erratic driving complaint, or any type of
Complaint. If the article is saying this then the article is 100% wrong. An officer needs continuity either from himself or witnesses that alcohol was not added after the driving occurred.

Yes, you can charge someone with impaired driving (bc doesn’t even do this anymore, they don’t really go criminal code anymore) if you belive they have driven a vehicle
While intoxicated within the last 3 hours, but unless there is 100% continuity of the driver and they did not consume anything after driving it won’t work.

Here’s a question. Even if this WAS possible. How do you prove the guy who opens the door was even driving?

I know a guy in town who quit drinking ten years ago. I seen him in the bar at around midnight , and he was playing Keno for something to do.
He was drinking orange juice , and at around 2am the cops banged on his door wanting a breath sample.
He’s like wtf ? And the cops were like , well we seen your truck parked in front of the bar .
He explained to the officers that he was bored and comes down to the bar to play keno on occasion, even though he doesn’t drink .
He never got an impaired obviously, but it’s just the thought of some cops getting you out of bed and hassling you in the middle of the night

I would imagine the intent of this is to prevent the cases where they follow a drunk driver home, and he runs into his house. Previously there was nothing the police could do.

Yes there was. It’s called fresh pursuit. An officer can go into any residence if they are following someone who committed a crime and they run inside the house. It’s not like a safe zone like ppl think.

we have privatized bottle depots in AB, In SK I believe it was run by the provincial government, and usually employed mentally challenged/handicapped people. I preferred taking my bottles to SARCAN in SK TBH. I feel I get ripped off (and probably am) in AB.

Yes, the Beer Store in Ontario is a private corporation and the LCBO is a crown corporation. I think they should force grocery stores to accept the empties back. Either way, I live in a big city and there's always someone looking in my recycle bin.
