"You can imagine a situation where a husband and wife are out together. The husband drives to the bar knowing the wife will be the designated driver on the way home, and she's not going to be consuming alcohol that night. The husband drinks alcohol and is now over the limit and has driven a vehicle within the previous two hours,"

Complaint. If the article is saying this then the article is 100% wrong. An officer needs continuity either from himself or witnesses that alcohol was not added after the driving occurred.
Yes, you can charge someone with impaired driving (bc doesn’t even do this anymore, they don’t really go criminal code anymore) if you belive they have driven a vehicle
While intoxicated within the last 3 hours, but unless there is 100% continuity of the driver and they did not consume anything after driving it won’t work.
Here’s a question. Even if this WAS possible. How do you prove the guy who opens the door was even driving?

people who text and drive are complete scumbags and should be pulled over and stopped.
People who drink and drive are also scumbags and laws that introduce stricter penalties or prevent this I'm for, but not sure if I agree or understand the full implications and application of this law as some people are saying the article is wrong.
