You have the "right" to a court appointed public defender to defend yourself against the government in criminal cases. You do not have that right in civil cases. You only have a "claim" to it if the government wants to institute legal proceedings against you

Where does OP get the notion we don't fund public education. It's most of the budget out here in CA. And celebs would just send there kids to good public schools which are all over the place. The notion that getting rid of private schools would force them to rethink things is just dumb. And the issue isn't money, it's the bad parenting and lazy teaching.

Nobody is legally entitled to charity care or any normal private business, if a charity turns you down you go home and that's the end of it. People are legally entitled to legal representation, they can't get turned away or denied representation altogether. Even if one particular lawyer doesn't want to do it, the court will appoint someone else, and the defendant can even claim their right was violated if below a certain quality of representation (see: Strickland v Washington).

So again, by your own definition ofhaving a just claim to something,it is a right. If you wanted to present some other definition of right, then you should have done that, rather than changing the goalposts midway then backtracking your whole argument and hoping everyone else's IQ and memory is as poor as yours and therefore would not notice.

if there is no public defender, or nobody willing to defend an indigent defendant, the courts WILL FORCE AN ATTORNEY TO REPRESENT THEM UNDER PENALTY OF DISBARMENT. the only reason this rarely happens is because there are usually public defenders available for this exact role - but not always. the RIGHT to an attorney exists regardless of whether or not there are any attorneys ready and willing to represent for free.

and they ARE free to the defendant. the defendant pays $0 for this representation

Well it's pretty easy to argue that with healthcare being a fundamental necessity for a remotely livable life, and a prosperous society, everyone has a just claim to it even if they cannot afford it. The reason we provide free legal representation is exactly because being guaranteed a professional defense is essential to the protection of our livelihoods, and from injustice, and to ensure fairness and equal consideration in society.

Really if society decides that healthcare is something deserving of being a legal right then it will be so, just like we have decided that legal representation is, and absolutely nobody cares what you think about it.

The point is that your whole argument is based on the premise that something provided by someone else de facto cannot be a right, which is empirically false, not based in the reality of any of the world US or otherwise, and is invalidated by your own definition of the word which is the really embarrassing part for you, hence why you avoided it and tried to skirt around it for this long.

it's that simple

and isingmodel has already answered your own question about healthcare. whether or not a claim is "just" is subjective. what you consider just i might consider unjust and vice versa. its a moot point whether or not we agree with whether the right is "just" or not. in the real world (ironically what you talk about here), "rights" are just whatever we say they are. we dont have a right to healthcare (currently) because the law says so. but we could change that and say wedohave a right to healthcare.

its really simple

in some countries their citizens are afforded certain rights. in other countries not so much.

this is basic

You told us that a right is a "just claim". People in our society have a "just claim" to legal counsel. You can, if you want, try and argue that nobody has a just claim to demand legal representation. You'd just be contradicting the Constitution, history, philosophy and general public opinion of the country.

No amount of whataboutism, backtracking on your own words, or hoping everyone else is as retarded and forgetful as yourself, is going to change this simple fact. So once we've established that people can have a right, or a just claim, to a service provided by someone else, then there's no reason why this could not be extended to healthcare.

You may disagree with it in the case of healthcare and that's fine, but that's not what we were arguing - we were arguing on the principle of whether someone can have a right, or just claim, to a service provided by someone else (answer for Slow Sy: Yes).

im talking about the literal right to representation here in the US - you seem to be talking about a theory or definition of what is a "just right."

you said theres no right to legal representation. i corrected you. you denied it and started talking about other stuff like healthcare and what a "right" is. it seems your entire arguments is based on semantics and your definition of "right."

did you know some cities, towns and municipalities DONT have public defenders? and that if theres no public defender available for a defendant, then the court will involuntarily appoint a local attorney to represent them, for free? ive explained this a hundred times. do you argue with your doctor about medical stuff the way you argue with me about law stuff? do you google your symptoms and then act like you know best about medicine and stuff?
