The only set of facts I've heard is that they saw someone who fit the description of a prior crime running past their house, not that they actually witnessed anything to do with what happened in the house. I don't have an opinion on Arbery as a person, but the first call came at 1:08 and discussed the house, and that the second 911 call known to be from McMichael came at 1:14 from someone who definitely does not sound like the same man. Tatum claims that McMichael saw him in the house, but I haven't seen anyone claiming the first caller is one of the McMichaels. It's certainly possible, but I think Tatum might have mixed up the two calls in good faith. As far as I know, the identity of the first caller given on the call hasn't been released, and that person explicitly says he does not believe it is a break-in. The 911 dispatcher seems confused about why this is even a 911 matter. Everything I've seen indicates that they thought he fit a description, not that they had witnessed a crime.

If they did witness him inside the house, it's still stupid games/stupid prizes. The process of getting this vague situation put in front of a jury and having to explain your actions is the prize. Bored, heavyset suburbanites need to stop pretending they're cops if they don't want to deal with weird chit like this. Nobody who has anything at all worthwhile going on in their life would think this was a good idea, specifically because common sense tells you you're probably either going to need a lawyer or an ambulance after.

Same boat op, I took it at face value he was jogging. I also took at face value he was seen coming out of a construction site. The fact it was a closed finished home that was broken into which makes it a felony, and the fact he is on camera strolling around, looking around to make sure no one was watching him then sprinting into the house to rummage around automatically makes you a criminal.

I was presented with facts being he was just seen walking out of a construction site. Also the fact billy bob and son saw him commit said felony was not mentioned. Now I haven’t seen evidence of this either because I didn’t do my research still but if I take those facts at face value it changes the situation dramatically.

I still think you are a fukking moron to try and make a citizens arrest instead of following and letting the police do it, but I can understand why arbery was confronted, play stupid games win stupid prizes. That saying will be applied to billy bob if he is charged with manslaughter cuz I don’t know what else to say about forcing that confrontation, but I can see how it’s self defense at that point for them.

I hate mixed race crimes. People will always cloud facts with bias. It’s natural.

I think those 2 guys should get jail time, but to me the WHOLE thing was avoidable.

I still believe they committed murder/did not have probable cause to chase down Arbery like that for the reasons I've argued before:

1) The daytime surveillance tape was confirmed to be Arbery, but he was not committing burglary. Mr. Tatumwasa police offer, not a prosecutor, so don't take his word as gospel.

2) The night time surveillance has not been confirmed to be Arbery, but if it does, I will definitely change my position on whether or not he was just jogging. But even then, I still believe it was simple trespassing, not burglary. The prosecutors have also looked at all the surveillance footage and still found probable cause to charge them with murder.

But the fact that the DOJ is considering pressing hate crime charges against them is insane. You can have racial biases and not be some Klan hood wearing neo nazi.

That isn't Georgia law. California law is almost exactly the same.

Basically has to be a felony and reasonable force. The firearms remove reason-ability of force with no violence being committed in his "crimes."

What happened here was probably a professional courtesy fukk up as much as, or more than, a race fukk up.

Old guy thought he could take his son out to play cops-and-robbers because he was a retired investigator and local would turn a blind eye when it went south. Old guy thought correct.

Real cops have qualified immunity. Civilians don't. In any situation where regular people take chit like this out onto the public roads, they're going to end up in front of a jury. So should he. If the facts exonerate him, so be it. No need to turn it into a hate crime thing, it's sketchy enough as-is.

The language in Citizen's Arrest laws can get sticky, which was how I got into back-and-forth matches with some miscers. My stance was that, since Arbery had not committed a felony, they had no right to chase after him like that. And even then, simple burglary, especially in a new construction should not warrant two gun-toting civilians to chase down a man because an ex-cop thinks he still enjoys the same rights as when he was in uniform.

I know miscers will reply with my location, but being an outsider and also your closest neighbour, I think my opinions are valid. Again, I'm not saying they're white supremacists or whatever the MSM narrative is, but it's hard to deny that a Georgia police officer wouldn't have some sort of bias, especially after being on the job for over 30 years.

No one had said that. Everyone had maintained that he was in a construction site for less then 4 min (max) and then went on his way. Homeowner came out and said he didn't take anything, cameras as well. The law for citizens arrest is very specific, and the 2 McMichaels and what they did, DO NOT fall under that circumstances IMO

They will be charged with Aggravated Assault, the murder charge.... that depends on how the lawyers try and spin their defense. (I'm very curious the route they will go)

Also the DOJ is investigating the way the case was handled (rightfully).

Every state has different laws regarding this. I don't know what Georgia's laws are, but in California in order to make a citizens arrest you have to either witness a misdemeanor, or you have to have probable cause that a felony was committed.
