The language for Georgia's laws is sticky. I've been back-and-forth with various miscers about it and I can definitely see their side. However, in Georgia, afelonymust be witnessed by someone or someone within their vicinity. Now, the argument can be made that the McMichaels actually witnessed it via their neighbor. However, to prove that he was there to burglarize an open construction, you'd have to prove intent.

There was another piece of footage that showed a person who matched Arbery's description who entered the same property in the night (the date isn't specified, although we're meant to believe it was some weeks prior) and nothing was taken. So to prove intent, the defense has to prove that the secondary footage WAS Mr. Arbery without a doubt in order to make a case for a lesser charge. And even then, it's a very weak line of defense because the owner of that home has gone on record to state that they've never had anything stolen on their property.

And again, Mr. Tatumwasa police officer, not a prosecutor. Take his words with a grain of salt.

He is mistaken about the 911 calls. He claims McMichael called 911 claiming he saw him running out of the house.

The identity of that caller hasn't been made public, and he told the police he didn't consider it a break-in. The second caller was McMichael, who apparently later told police he pursued Arbery because he "fit a description", not because he saw him commit a crime.

Watched the video. Unlikely to get convicted when the guy went for the gun. In that moment, he has a reasonable belief that his life may be in danger so he can use lethal force to defend himself. You're allowed to make a citizen's arrest if a felony has been committed. It sounds like a ****ty situation that went really bad when the guy went for the gun. I could see why he would go for the gun, but I can see how the accused could fear for his life at that point. The fact that he brought the gun out is not relevant if the video is true about the open carry laws. The video doesnt show him pointing it at him (at least I didnt see).

If that's all that happened then sure, but it's not. They had been following ahmaud for a while at low speed then stopped in front of him and got out. They did not have first hand knowledge of whether or not it was him, only his description. If you provoke, then you lose your right to self defense in GA.

Like I said, everyone is guilty.

I'm proud of that guy that made the video, it's was very good.

I still don't think using lethal force is okay in a public place when no direct action was taken against anybody by the suspect. The guys brought guns to a discussion and triggered the whole thing.

However, there's enough where I now see it as a pretty mild crime.

I know there's open carry laws, but can you point it at someone?

Say I had a rifle and walked down the street pointing at people, is that legal?

I believe the black guy was snooping around and was likely a mild and future threat to the area, but the response was very dramatic, and them coming after him with guns is okay, but it pointing them at someone okay?

What type of response would that get from people?

They would run, freeze, attack.

Run and attack would then give the person brandishing, not carrying, a gun the excuse to kill.

There's got to be some laws about that.

Where I grew up there was a lot of hunting, so you were allowed to have a gun over your shoulder, like on a strap in public. That is where I'm getting that from. Soldiers will carry guns barrel up, because if it fired it's going into the air. You were allowed to have a pistol but it had to be in a holster, you couldn't walk around in public talking with your hands while holding a pistol, lol.

In this case, I doubt they arrived with guns held in some legal safety position.

Low carry is legal. There's about 50 pages of argument over this in the r&p section. It's probably worth reading the whole thing before going down all these discussions again.

Hate to burst your imaginary bubble but I’ve been in court a few times for minor charges, dressed up nice, played my nice little white boy card and I got of with slaps on the wrist while everyone else in for the same chit (minor possession) got the book thrown at them.

Cops also let me drive home after telling them I had a beer at work on top of the stuff they found on me. They said I was one of the coolest/interesting people they had talked to and most of the people they interacted with had nothing going on for them.

Might have just been me being a suck up and knowing what to say, but the Mexicans and homies got some fukt punishments while I got off ez.
