I don't necessarily agree with mask mandates, but I think Jacobson v Massachussetts kind if disagrees with you.

I think this went way too far but in regards to Constitutionality it may be hard to win that argument in court.

This would likely fall closer to Cruel and Unusual and that the punishment doesn't fit the crime.

I think the guy in the OP has a case for lawsuit simply because of the unprecedented punishment. Ibelievethat generally the accepted punishment for not following these mandates is simply a fine, not a one year prison sentence.

I didn't see your edit but I agree that COVID vaccine should not be mandatory. I'd like to see it rolled out similar to flu shots.

I mean, right to peacefully assemble is literally right there black and white with shall not be infringed in the 2nd, etc. The unfortunate truth is those are just words and they will be interpreted by those who are representative of the people and have the power. Might makes right, and thus whomever controls the Supreme Court controls the way that law is "interpreted". Not that any of it matters anyways, this countries laws are so far from it's original set we may as well rename it.
