In the eyes of the law him being a minor is irrelevant. That’s clear self defense no matter what age you are. He probably won’t even get convicted of the gun possession misdemeanor either, because that law only applies to short barrel rifles, which obviously doesn’t apply to him in this situation since his gun was long barrel.

Basically, the act of breaking into a house in CO can get you legally set to room temperature by the occupant . . . because it's not a very high bar to assume that someone breaking into your house might not have good intentions with regard to your physical wellbeing.

Thankfully, a law that was passed in the 80's when this state wasn't infested with progressive locusts.

The photographs just show that they're having a confrontation. From the circumstances in that video where the shooting occurs off-camera, the dead guy sees something to his right while that black guy is yelling, raises his mask, and walks off aiming his pepper spray in that direction. You can hear the pepper spray go off and the shot nine seconds later.

My theory is that he was trying to get them to stop filming this confrontation and that the security guard intervened because he had a weapon pointed at the reporters he was paid to guard. It looks like the guard may have tried to push the pepper spray away or grab it away as the dead guy struck him. At the time the first of those photographs are taken, the guard didn't have his gun out, so this was probably not a reaction to that.

Several states have held that pepper spray can be construed as a deadly or dangerous weapon when used offensively, or found temporary blinding from pepper spray to constitute serious injury. It isn't consistent from state to state and I don't see anything settling this in Colorado, but their statutory definition of serious bodily harm for self-defense requires "protracted" temporary loss of use. The meaning of "protracted" temporary blindness is arguable, and might be contextual. (Ten seconds of blindness in your living room is scary but not the end of the world, doing 75 on the freeway it's very possibly the end of your life.)

Either way, dead guy had a family. Sad way to go out, pepper spraying a guy with a gun hoping he won't shoot you in the head. Whatever happened, legal justification won't mean much to him now. This chit was not worth it.
