As suspected, not a reason to get out of the car and not a reason to demand someone to exit their vehicle or detain them. They have a right to check your papers regarding the plates, but that is all....depending on the papers.

"Passively resisting" doesn't exist. It's an oxymoron and impossible. He probably didn't want to reach down for his seatbelt and get shot because he was "reaching for something". He posed absolutely no threat. The cop did nothing except escalate the situation as much as he could.

Maybe memcop can chime in, and I’m sure it’s different state to state, but I believe if an officer asked you to step out of your car you have to comply. You can also lock the car when you do and not allow them entry. Beyond that you don’t have to do anything else (beyond the normal sharing of license and registration).

Honestly what he did is hard for a guy to do, being yelled at constantly and expecting to comply with something he doesn't have to comply to or face being shot for putting his hands down, but he did everything right and now will win a lawsuit.

He was worried about living or dying, you could tell by how hesitant he was to even move. He was afraid to release the seat belt over fears that a trigger happy officer would end him.

He drove for nearly 2 minutes after they first tried to pull him over. He had tint that made seeing his temporary license plate extremely hard. That warrants the aggressive measures they took, especially when he wouldn’t comply subsequently with basic orders. Imagine if everyone used the same excuse. Hey I’m afraid to get out of the car because I’m being racially profiled! I don’t need to follow completely lawful orders. Learn to think.

So the cops in this were definitely unprofessional, no way around that, but the guy should have followed their fully legal commands and gotten out of the car. People always say "I know my rights" when they don't. If you knew your rights, you would be exercising them and allow the police to exercise theirs. Most of the times it's the criminals that have been through the system and have lots of police interactions that know the most about their rights compared to the college educated guy that took some criminal justice / law classes.

For people reading, if an officer tells you to do something, you generally have to do it. Pay attention to when they ask something "You have anything illegal on you? Do you mind if I check?" or "Do you mind getting out of the car?" vs tell you something "Get out of the car". You can exercise your rights for the questions, not for the commands. Not following the commands just escalates the situation for everyone, and actually gives the cop more "ammo" to escalate the detention. You also aren't immediately entitled to the reason for the stop. The report will read something like "During my traffic stop, miscer1 continued to move around in his vehicle despite my commands to keep his hands on his steering wheel. Due to this, I commanded miscer1 to step out of the vehicle so I could continue with the citation process. Miscer1 continued to refuse to get out of the vehicle, and continued to move his hands around in his vehicle.... blah blah blah"

No, it doesn't, pal. They should have let him go immediately when they saw the temporary plate after they pulled him over and apologized for the misunderstanding. It's clearly visible in the video. At that point, the excuse they had to pull him over becomes irrelevant. In addition, they gave him conflicting orders. How the fuk are you supposed to hold your hands outside while undoing your seatbelt? He was clearly trying to play it safe whilst these stupid cops were off their rocker. Learn to think.
