if u live in a “right to work” state like me, we’re prob fked unless we can pull that CVS chit some posters are talking about above and get the card and then just walk out with the card and not get it

The only part we're disagreeing on, that I don't see anywhere in HIPAA, is that he as the user and not the provider has to divulge his medical history if asked. I'm no lawyer, but I would think it'd be an easy bridge to build in a case that if HIPAA says your medical history cannot be handed out by your provider without your consent, then you wouldn't have to give consent if they were soliciting you directly either, i.e. - he can decline to comment.
