How likely is it that her insurance will not give me the runaround and try avoid paying for this? I already called them and filed claim but i am afraid that since it was in the parking lot and she did not get a ticket that they may try to avoid paying for tihs.


Any tips ??? Should i look into getting a lawyer? I am freaking out mainly because i just learned that if her insurance doesn't cover it ill have to pay to fix it. PS fuk GAICO gonna be going back to Esurance.
If she has state minimum insurance you are Sol. Btw do not take your vehicle to where her insurance tells you to go they will trick you and do cheap parts and Shoddy work. Try to take to Ford Dealer Auto body or Maaco they have Lifetime Warranties on their repairs. Any shop that has good reviews and lifetime warranties.

I totally get this from a police perspective.

But for people actually involved in a car accident on private property they are likely to be better off if they have a police report. The adjusters for the two insurance companies [assuming both drivers are insured and it isn't a no fault state] will probably haggle over comparative liability [most states] and each will attempt to accept a smaller percentage. Many times adjusters will just call it 50/50 to get the claim completed if there is no police report to prove that either party admitted to any fault in the accident [private property]. 50/50 may sound fine, except that it might not reflect the facts and could lead to a raw deal for the driver with a higher $ amount in damage.
Comparative Negligence: A “Partial” Defense

The comparative negligence system allocates fault between the parties. Under the comparative negligence system, adopted by most states, a defendant can raise a partial defense, saying that the plaintiff was partially at fault for the accident too.

Here’s an example of how this works. Say that Dan is making a left turn and hits Ann who is driving over the speed limit through the intersection. Ann sustains injuries and sues Dan for negligence. Under a comparative negligence system, Dan may be found to be 80% at fault for hitting someone while making a left turn and Ann may be found to be 20% at fault because she was speeding. If the total available compensation is $100,000, Ann will receive $80,000 instead of the total amount -- her amount is reduced according to her degree of fault [20%].
Once upon a time I worked in the national subrogation center for a big auto insurer.

ETA: Not for you to worry about OP since your car was parked. This is most often parking lot accidents where both vehicles are moving.

The only reason my car is worth 30k right now is because of the car inflation prices due to pandemic and chip shortage.

It was 37k out the door brand new in 2015 and only reason it was 37k is because it was GT premium with performance package.

Mustangs have gone up in price though similarly spect 2021 GT's go for 45-50k now


PS i do not claim to be rich if i was i would not be living in a townhouse with no garage lol.

You're winging it bro. You said someone broke the law. The only enforceable traffic law is dui and reckless driving. Neither of which are exemplified here. No one broke the law. No police action can or needs to be taken. Easy doesnt mean anything under criminal application. Its binary. Fuk your feelings.

I called the non emergency number and told them that someone hit my car in the parking lot and they said they would send someone out.

When i got out and noticed the note and she came out and asked me not to call the police i called back letting them know that the person that hit my car came out of the house and is saying that police is not necessary and the dispatcher was like i can call it off but if it is extensive damage i recommend you let us do the police report and so i said ok and they came. So glad they came at least she can't claim that it was not her that hit the car anymore becasue she told the police officer she did.

Not saying she would though as she seemed very nice.

no she did not break the law. Driving a private vehicle on private property and accidentally hitting a vehicle is not breaking a law. There is no road system maintained by any government entity so there is no traffic law on private property so no traffic offense has been committed to break a law. This is literally the equivalent of someone accidentally throwing a baseball over the fence and hitting their neighbors window. That is not a criminal matter, that is not a police matter, that a civil monetary issue.

The police are not your be all end all for all bad things that happen to you in life. Sometimes you have to put the big boy pants on and deal with situations without the police.

Katya, im sorry but the same response. Just because you feel better about the police doing a report doesnt mean anyone is entitled to it. IF the police say sorry this is a civil issue, because insurance information was exchanged and this was on private property we will not be doing a report. I have said this many times because im not spending 20 minutes of my day doing an accident report so insurance companies can have an easier job. Literally all you are doing by making police take a police report is for them to act as a secretary and collect information to give to an insurance company. We are not paid to be secretaries for insurance companies. It is your job to call the insurance company and give them the information you would have given to police.

Some tradie hit my car and did more than 2k damage in a lot. Got photos of his insurance, and dl.

Instead of dealing with insurance companies I just visited the police station and got a policewoman to call him up.

I'm not mad. I understand that accident reports aren't a top priority. I've never called in for one myself, though I've been rear ended a few times. IIRC some cities are even delegating it to some type of unarmed civil servant.

Just stating for other miscers thatifyou can get a police report it would probably be in your best interest. Unless you're the idiot that was swerving to miss a cat.

They're probably going to do everything in their power to not pay out. If at any point they offer resistance or go NC, just see a lawyer and let them deal with it.

Looks like a total to me, a lot of work to get that front end fixed, I had a similar accident years ago. This is EXACTLY the reason why, if you have a nice-ish front-engined car, do NOT park with your front end facing traffic. If OP hadn't ego parked he would have had fairly minor rear bumper damage, maybe $2k and he'd be on his way. Instead it's a near total.

good move on filing police report as she could always change her story to insurance and it will screw you later.

as long as she admits its her fault, her insurance should cover most of it.

if you dont have rental coverage you might not have this car for a while as due to pandemic, body work and car repairs are taking very long due to difficulty in finding parts, in your case it looks like under the hood damage also as some liquid is leaking.
