I was sued for 3 years on a supposed fender bender where the car at MAX speed could have been going 5 mph

Her insurance is a pos

Her insurance would not start the repair process until they talked to her even though they had the police report that said it was her fault and her admission of guilt on police report.

They claimed for 10 days they tried to call her and were not hearing back so finally I texted her and within 10 minutes she called the claim expert guy and told them it was her fault.

Sheโ€™s good peoples apologized again and said if I need anything else to let me know. Stupid insurance guy wanted me to knock on her door and I told her that and she said I can come anytime.

Adjuster is coming today to take pics so finally they are starting to take care of it.

The police report did indicate her at fault and included her statement which pretty much said my car was parked she lost control and hit my car. Nobody was in my car at the time of accident so really impossible for these ****ers to try and fight this but they still stalling.

Police report puts her and her insurance agent in the coffin. Had he not done that this would have been a far worse process.

It was the insurance being scummy. The minute I sent her a text she responded that she would call in 10 min. She updated me that it went to voice mail.

She that called her insurance agent to complain to her about them not fixing my car. Her insurance agent called me and said that she called her and she will personally call the claims guy too.

Like an hour later the girl who hit my car texted me again and she said she reached the claims guy and told him it was her fault not even 10 minutes later I had a guy calling me telling me heโ€™s coming Monday to take pics of car.

She is good peopleโ€™s if she didnot leave note on my car Iโ€™d be ****ed. I doubt the police would give enough **** to do proper investigation and track down who actually did it and with me having liability insurance I would have been on the hook paying out of pocket yo fix the car.

So I canโ€™t really be mad at her dunno how she did it but **** happens it is what it is.

those saying its totaled lol, hopefully the body shop doesn't take too long on getting parts but we've been dealing with part fulfillment issues due to the shortages so hopefully thats not your issue

This right here OP. Get the repair quote from YOUR repair place. Not sure how it works in other states but assuming if similar to CA, once you get a repair quote from a shop recommended by her insurance company, that quote will be a hard ceiling. The thing about non-OEM parts is you donโ€™t donโ€™t know what the shop had to do to get the part to fit in your car (bend/stretch).

Be careful on the rental - itโ€™s not an โ€œunlimitedโ€ benefit. There is usually a hard $$$ cap but hopefully your repair can be fonibefore you reach this cap.

Not to sound like a prick, OP, but this is why you avoid parking any sort of expensive vehicles in the street. I've had my old car slammed into twice, in those cases they were hit and runs. One time I busted the guy who did it and made them/their insurance pay for the damages, the other time I didn't know who did it and my insurance took a slight hit from utilizing my full coverage.

So trust me, I know how much it sucks. I'm just saying, you might want to reconsider how expensive of a vehicle you want to own if your only option for parking it at home is street parking (parking on the street at home all the time drastically increases the odds of someone hitting it eventually vs. just occasionally in random public places). Back when I still had to park on the street where I lived at the time, my car was worth maybe slightly north of $1k lol. Wouldn't even think of putting anything worth north of $10k out on the street on a regular basis.

I got the car in 2015 but I agree I would never buy a new expensive car or recommend anyone get one if you donโ€™t have a garage. The random dings and scratches you find will drive you insane alone. I have two cars now but I suggest anyone buying $40k car have two cars , One car to take when shopping and doing chores and the nice car to take out on the weekends.

Guy came out took pics nice guy said he will send me report later today. He showed me there was some rust on my hood and he will put on there to replace the whole hood instead of just fixing the damaged part to take care of me.

So far the only scummy guy had been the insurance claims guy .

If she told her insurance she did it, they will likely pay for it. Its all recorded conversation (to avoid fraudulent claims).

I would've demanded a police report, just based on the damage. In my state, if it's on private property, damage is less than $500 and no injuries, a crash report is not required. A crash report is much different than "reporting" aka calling the popo. That's definitely more than $500 in damage, and technically, it was a hit and run if ALL she left was her phone number and a "whoopsies" sticky note lol.

Go back, take photos of all of her information; insurance card (verify VIN, date and coverage), registration, damage, scene and get her most up-to-date contact information, including address. Exchanging THIS information satisfies state statute (for my state, anyway). You still need to report it to law enforcement or complete an online State crash report (per law). Your state laws might be different.

When this stuff happens, I usually just give them a "driver's exchange", meaning give em the above information of all vehicles/parties involved). If one party is adamant about wanting a full crash report, I just do it. Lazy cops / troopers wont do sh*t but tell you they cant or wont.

Also, aint no damn way that's totaled. They will repair it.

Just make sure they double check suspension and cooling & heating components. The car, being parked, will likely suffer from some degree of suspension damage IMO. The frame is likely fine.

I don't know about other states but in TX the law requires you to inform the Police of any accident that causes injury or the apparent damage is more than $1000. Now it does not say that an officer will come out and file a report but you can do that yourself online. However it is clear that you must inform the Police at a certain point and it does not specify if the accident has to occur on a public roadway or not.
